A cadastral passport is one of the important documents that confirm ownership of real estate. Most apartments that were purchased from citizens a long time ago are not registered in the cadastral register. To sell an apartment, exchange it or donate it, you must receive this document.

It is necessary in the following cases:

  1. To register ownership of secondary housing in Rosreestr;
  2. When registering ownership of an apartment in a new building;
  3. Banks require this document when applying for a mortgage loan;
  4. In order to legitimize the planning carried out;
  5. During legal proceedings, for example, if a person needs to be evicted.

There are three types of apartments for which it is necessary to obtain information from the cadastre:

  • Residential premises that were owned for a long time, but were not registered in the cadastral register. The owner must arrange them independently;
  • If the apartment is inherited. In this case, the heir himself is responsible for the registration.
  • Residential premises purchased in new buildings.

You can receive a cadastral passport for the first time when registering your home, or you can get a second one if you lose your old one, during redevelopment, or to submit it to the bank.

What is this

A cadastral passport for housing is a paper that contains the characteristics of real estate. As soon as an object is registered in the cadastre, it is assigned a special number and a document is issued. The form contains important information about the apartment, for example, its address, area, layout, owner, price. This is why paper is required for all government procedures related to real estate.

A document can be used for different purposes, and the most common are the following. Firstly, it is needed in order to remodel the apartment. Secondly, it is required to formalize purchase and sale, donation, inheritance. Thirdly, if legal proceedings with property are required, then a form from the cadastre must also be submitted.

That is why you need to immediately obtain a cadastral passport from the MFC, so as not to worry about it later and not waste time contacting a government agency. Please note that this procedure can only be carried out by the owner himself or his representative. In the second case, a power of attorney to carry out the process will certainly come in handy. However, if a person wants to receive a cadastral extract, then it is available to everyone. It contains important information about the object, but nothing confidential.

What documents are required

To submit an application, you must first collect a package of documents:

  1. A document confirming the identity of the applicant;
  2. Completed application. It can be filled in when serving;

  3. Technical plan of the apartment, which must be pre-ordered from the BTI;

  4. Documents confirming rights to real estate. This could be a deed of gift, a purchase and sale agreement, or a certificate of inheritance.

  5. Receipt for payment of state duty.

You must first call specialists from BTI to draw up a technical plan. You can conclude an agreement with BTI employees under which they themselves enter the apartment into the cadastral register, and the owner is provided with a ready-made cadastral passport.

If the passport was received earlier and needs to be restored, the package of documents becomes smaller. The applicant will need:

  • Application for re-issuance of a passport;
  • Identity document;
  • Receipt for payment of state duty.

After submitting the documents, the employee issues the applicant a receipt indicating the date the document was received.

In new buildings, developers are most often responsible for obtaining a cadastral passport. They register the house and each apartment separately. The owner of the apartment only applies to Rosreestr to register ownership of the property.

Cases of refusal to issue

It may turn out that you were refused to obtain a cadastral passport through the MFC. There is no need to worry because this issue is usually resolved quickly. Reasons for refusal to issue may be:

  • Incomplete documentation provided
  • Documents filled out with errors
  • The object of registration is not registered in the cadastral register
  • A person does not have the right to carry out legal transactions with a registered object or does not have a power of attorney to carry them out on behalf of another person
  • State duty not paid
  • The registered object is not real estate
  • For example, a land plot being registered crosses the border of a populated area

MFC employees are required to explain the reason for the refusal and advise on how to correct the errors. A common reason is errors in filling out paperwork. To resolve the issue of not issuing a receipt, most often you just need to deliver documents with the most accurate information. After correcting the shortcomings, the application is sold again. If important points are covered, then no more problems should arise and within a week you will be able to receive the requested document. The application process is quick and hassle-free if you followed the instructions correctly.

In conclusion, it is worth concluding that obtaining a cadastral passport is a simple operation if you follow the steps consistently and take into account the necessary requirements. Its design will not take you much time. Having received this document, new opportunities and rights open up, which are necessary if you are going to resolve any issues related to real estate. The main thing is to approach this matter responsibly and seriously.

Where to get a cadastral passport for an apartment

There are three ways to obtain a cadastral passport for an apartment:

  1. Order online on the Rosreestr website;
  2. In the Cadastral Chamber;
  3. Through the multifunctional center.

Online via Rosreestr

The document can be ordered online on the Rosreestr website. This method is very convenient for those who do not have enough time to visit organizations or wait in queues.

The cost of the state fee for obtaining a document does not depend on the chosen method. You can obtain a passport either by appearing in person at Rosreestr or by submitting an application online. When using the online ordering method, you must choose what type of document the applicant requires and how he can pick it up.

Depending on the form of the document, the state duty will be calculated.

To order a cadastral passport online, you must complete the following steps:

  1. Go to the official website of Rosreestr;
  2. Fill out the application fields;
  3. Pay the state fee.

After processing the documents, the applicant will receive a notification about how and when he will be able to pick up the finished document. You can obtain a passport yourself by contacting the territorial body of Rosreestr. The second way is to receive the document by mail.

When filling out the application you will need to indicate:

  1. Type of document required;
  2. Type of property;
  3. Property address;
  4. Information about the owner, address, passport details;
  5. Type of completed passport: electronic or paper;
  6. Receipt location: home address if you need to receive it by mail or email address if you need to receive the document electronically.

Obtaining a passport online is convenient for those who do not have the opportunity to stand in queues.

MFC

When applying to the MFC, the applicant must collect the same package of documents as for Rosreestr. The advantage of submitting an application through the multifunctional center is that a citizen can make an appointment at a time convenient for him.

In order to apply for a cadastral passport through the MFC, you must:

  • To write an application;
  • Provide a package of documents;
  • Receive a receipt confirming the acceptance of the application and the date when you can receive your passport.

The processing time for a cadastral passport through the MFC is 10 working days.

Order through government services

Most citizens actively use the State Services portal. This is a service for providing government services online. Thanks to this service, you can issue the necessary document without leaving your home.

You must first register on the website:

  • Registration must be confirmed at the MFC, but confirmation is required only once;
  • Next, you need to find the Rosreest tab on the portal and obtain documents from the cadastre;
  • The program will provide a field to fill out the application;
  • After filling out the form, you need to wait for confirmation of the request verification;
  • Next, the applicant can choose the method of obtaining a passport.

The electronic version of the document has the same legal force as the paper version. The only difference is the production time. You can receive your passport by email within two business days. A paper document is produced within five working days.

Other ways to obtain a cadastral passport

In addition to obtaining a cadastral passport for an apartment through the MFC branch, you can apply for it at the Cadastral Chamber (branch in your city) or fill out an application through the State Services portal. However, when applying online, you can only receive an electronic version of the document. To obtain the original, you must also visit a branch of the Cadastral Chamber, where there may be queues, closed days and limited reception hours. The most convenient way to receive it is still the MFC branch, since the Multifunctional Center is open, as a rule, until 20.00, competent specialists help in drawing up the application and check the availability of all documents.

State duty for receiving

Obtaining a cadastral passport for an apartment is subject to payment of a state fee. The amount of the state duty will depend on the status of the person receiving the passport. Legal entities and individuals pay different amounts.

A receipt for payment of the state fee must be attached to the package of documents upon application.

Nuances:

  • Tariffs for state duty are established in accordance with the Tax Code;
  • Payment can be made in various ways, either in cash when filling out an application, for example, at the MFC, or by non-cash.
  • Payment must be made according to the details received from the Rosreestr authority;
  • Payment details for individuals and legal entities differ;
  • The application for a passport will be registered and accepted only after confirmation of payment of the fee;
  • For those who order a cadastre extract or passport, it is possible to pay the fee through the electronic payment system.

Required documents

The list of required documents may differ and depend on whether the property is registered or not.

To carry out initial registration in the register, you must prepare the following package of documents:

  • a copy of the property owner's passport;
  • application for inclusion of property in the register;
  • technical plan of the real estate, which can be taken from the BTI;
  • supporting documentation on the existence of rights to property;
  • a receipt confirming payment of the state fee.

BTI employees are engaged in issuing a cadastral passport. Drawing up a technical diagram of the apartment and its plan may also be part of his responsibilities.

So, the owner of the property must enter into an agreement with the BTI, taking into account which, the state cadastre will enter the apartment into the register and will be able to issue documents in the name of the owner. The issue of generating a passport for an apartment in a new building is handled by the developer.

If a multi-storey building is included in the cadastre, then each apartment is taken into account as an independent object.

If there is a need to re-register paper for property already included in the register, the following documents will be required from the property owner:

  • application for paperwork;
  • a duplicate of the apartment owner's passport;
  • receipt for payment of state duty.

Upon acceptance of the application and the package of documents attached to it, the employee of the cadastral service or multifunctional center provides the applicant with a receipt confirming the acceptance of the papers and names the date of receipt of the completed passport.

To receive online through the official website of Rosreestr, you must first register. Further actions are carried out very quickly: using the section of electronic services and information of the State Property Committee. An application opens, which must be filled out indicating information about the real estate.

The site provides the opportunity to make payments for government services provided.

Contacting the MFC involves the following steps:

  1. The applicant's passport and a receipt confirming payment of the state duty are submitted. All multifunctional centers have special terminals that allow you to make payments for state fees.
  2. Submitting documents and filling out an application.
  3. Upon completion of the verification of the provided documents, a receipt will be issued indicating that the MFC employee has accepted the package of papers.
  4. A visit date is set to receive a new document.

The package of papers can be submitted either by the owner of the property independently or by specially hired people engaged in the relevant type of activity.

When contacting the MFC, it is possible, if the list of documents provided is incomplete, to supplement it in a short time and wait for the required paper to be produced.

It is recommended to check the prepared documentation in advance and carefully prepare for the upcoming procedure so as not to lose your personal time and avoid unpleasant moments.

What is the price

The cost of registration depends on who submits the application: an individual or a legal entity.

To obtain a passport, an individual must pay an amount of 200 rubles, a legal entity is subject to an amount of 600 rubles.

On January 1, 2020, a federal law came into force that united all information about real estate into a single register, and information in accordance with this law is contained in a single system.

Such a system allows citizens to simultaneously submit an application for registration of rights and registration of an object in cadastral registration.

The type of document that contains information about the cadastre of a real estate property has also changed. Now citizens will be able to receive an extract from the Unified State Register. From February 7, 2020, citizens can receive a free extract from the Unified State Register of Real Estate on the cadastral value of real estate on the official website of Rosreestr.

Difficult moments

When submitting an application for paper production, you may receive a refusal, and employees of the authorized body may not take the documents. This may happen for the following reasons:

  • the documentation that was submitted to the authorized body contains errors;
  • provision of an incomplete package of documentation;
  • the application was not submitted on behalf of the owner of the property in question;
  • in case of incorrect transfer of authority to perform actions to another person, for example, the absence of a power of attorney from the owner of the property or its erroneous execution;
  • other similar reasons.

Upon receipt of the refusal, the applicant must correct the detected errors and reapply for a cadastral passport. Another option involves solving the current problem through litigation.

Based on the above, you can order a passport in several places, and obtaining it is a fairly simple procedure and requires care in preparing the necessary documents.
