How and where to get a cadastral passport?

Does the cadastral number change when the owner changes?

Information about its new owners is entered into it and the passport is sent to you within a very short period of time. This method will save not only your time, but also money. Another reason for changing your passport is a change in your real estate. Let's take a plot of land as an example. It marks all buildings that are important for the cadastral chamber and Rosreestr, and also marks the boundaries. And now, a situation arises when you start building another building.

Is it necessary to change the cadastral passport when changing ownership?

If it is necessary to draw up such an act, coordination of boundaries may take from 2 to 6 months.

The duration of the process is due to the fact that it is necessary to find all the owners of neighboring lands, obtain their written consent to establish boundaries by drawing up the appropriate act, conduct geodetic and cartographic surveys on the ground, and determine the location of the installation of boundary signs.

You can receive a cadastral passport not only at a personal appointment at the MFC or the Cadastral Chamber, but by ordering the document online by email or on a physical medium through Russian Post.

Completing an application online takes a few minutes.

This could be a newly drawn up boundary plan due to the appearance of a new building or a change in boundaries.

There can be hundreds of examples, the main thing is that your words about changing the cadastral plan are documented.

The list of documents does not end there. The most important document is the application . It must be in printed text or in writing, but must be legible.

Also, the application must contain the date and your signature. The application is drawn up on an A4 sheet of paper. The application must indicate absolutely all attached documents on the basis of which you want to make the necessary changes.

The difference between a cadastral passport and a technical one

The difference between passports for real estateWhen studying information about whether a cadastral passport is now being issued, it is worth noting that ideally, the documentation package for each homeowner should include three main papers

:

  • certificate confirming ownership;
  • cadastral passport;
  • technical certificate.

The latter was issued by the BTI, which is now called PIB. A registration certificate must be issued regardless of whether the apartment was purchased in a new building or chosen among secondary housing.

The key purpose of the technical document was a detailed description of the characteristics of real estate. For buildings, this will be a detailed layout of premises, rooms, number of floors of the building, the presence of utilities, their features, as well as the material from which the walls and ceilings are made.

For the site, these will be precisely designated dimensions, locations of structures, and definition of boundaries.

Unlike a technical passport, an extract from the Cadastre does not contain all the technical details; the information is more general in nature. The principle of obtaining the latter comes down to the need for state accounting of real estate, property rights, and registration of legal transactions.

The validity period of the technical passport is not specified by law. However, every five-year period the State Register conducts an inventory of registered real estate, as a result of which the cadastral value of the property may change. Therefore, it is necessary to obtain an update of the document every five years. The expiration date of the extract from the Cadastre occurs 30 days from the date of receipt.

It is also worth considering that encumbrances and other restrictions on rights are not indicated in the cadastral passport. To obtain such information, you will need to send an additional request.

Everything about the cadastral passport of an apartment

Necessary information about the cadastral passport for housing

The cadastral passport can be considered one of the most important documents for residential space. Without this document, it is impossible to fully manage your property. In the vast majority of transactions, a cadastral passport appears, and in some cases it is decisive. This article will tell you what a cadastral passport is, why it is needed, and how you can get it.

Why do you need a cadastral passport?

This document must be in your hands in the following cases:

  • conducting any type of transactions with your property;

That is, if you decide to rent out, sell, buy, donate, bequeath, or transfer residential premises to non-residential status for commercial purposes, then you must have a housing cadastral passport.

  • in cases where you go to court to evict someone from an apartment where you are the owner;

There are times when unscrupulous realtors or their own dishonest relatives play a trick and arrange for a complete stranger to live with you. In such cases, only a trial will help expel the uninvited guest from your own home.

  • when carrying out or legitimizing redevelopment that has already been done.

If you are moving into a completely new apartment, which is located in a new building and has only recently been put into operation, then you must independently obtain a cadastral passport from a special organization that issues such documents. It is called the Cadastral Chamber. If you did not receive a cadastral passport upon entering a new building, then in the future this will result in unnecessary waste of both time and money when you want to carry out some operations with your property. Therefore, it is necessary to make a cadastral passport on time.

What does a cadastral passport look like?

This document is a specially prepared extract from the state register of property. The cadastral passport must necessarily reflect such indicators as: layout, total area of housing and separately for each room, floor, absence or presence of a balcony and similar important information. A graphic drawing is attached to the cadastral passport - a plan of the apartment. All rooms of the home with footage are drawn on it. If redevelopment has been done, then a separate sheet of paper must include a plan of the apartment before the redevelopment and a plan of the apartment after the redevelopment has been carried out.

If a passport is obtained for a completely new home, then it consists of two A4 sheets. The first sheet will reflect all the important characteristics of the apartment and the cadastral number will be indicated. The second sheet will contain a plan of the entire flight of stairs on which your living area is located with marks on the footage.

Instructions for issuing a cadastral passport

This document is drawn up at the Federal Cadastral Chamber of the Federal Service for State Registration in the cartography and cadastre department. In addition to this organization, it can be obtained at the Multifunctional Center (MFC) or by leaving an application on the official website of Rosreestr. There is no difference in where exactly this document was received, so further instructions will be written on how to obtain a passport through the Cadastral Chamber.

Any citizen of the Russian Federation can obtain this document for residential space. Moreover, such a passport can be obtained both for your own housing and for someone else’s. But for someone else’s housing, a publicly accessible version of the cadastral passport will be issued, where only non-confidential information is indicated. In addition, only the owner of this property can make any changes to this document. Also, only the owner or tenant has the rights to register their housing or make any changes to the register if, for example, redevelopment or any other modification has been made. After this, you need to get a new passport, which will reflect all the current changes that have been made to date.

  1. The first thing you need to do is contact the Cadastral Chamber yourself and fill out a special application.

In cases where obtaining a cadastral passport is associated with mandatory registration or the need to make any changes to the register, the Chamber must notify the employee about this. Such changes cannot be carried out without calling a special master to the house, who would witness the changes made and evaluate their correctness and legality. Carrying out such an inspection is a necessary necessity in order to obtain a new cadastral passport, which will record all the changes made. It is worth noting that such actions with the register can only be carried out by homeowners.

When visiting the Cadastral Chamber, you must have a certain set of documents with you, which will depend on the specific purpose for which you need to obtain a cadastral passport. The Chamber is required to issue any citizen of the Russian Federation who has a civil passport with a cadastral passport for any apartment. But this passport will contain only publicly available information. However, only the owner can make any changes to the register, as well as apply for a new passport if any modifications have been made to the living space. In these cases, you need to have the following documents with you.

  • Documents that would confirm your right to own your own living space. If the apartment is registered as a property, that is, privatized, then you need to have a certificate with you that gives you the right to own the property. If the apartment is under municipal control, then you need to provide a warrant or a social tenancy agreement. If an apartment is purchased in a new building, then you need to provide an agreement with the Developer on the purchase of the apartment or a transfer deed if there is no certificate for this living space yet.
  • If obtaining a new cadastral passport is associated with redevelopment, then everything will depend on what stage the work is at. If you are just planning to do it, then you need to have a technical passport and a project of how the redevelopment will be carried out. If it has already been done, that is, it is of an unauthorized nature, then in addition you need to have a positive court decision that such a redevelopment could be done, a conclusion from the SES and the Ministry of Emergency Situations.
  • In cases where the homeowner himself, for some reason, cannot obtain a cadastral passport, he can be replaced by an authorized person. To do this, you need to obtain from a notary a confirmed power of attorney stating that the owner transfers part of his powers and allows the authorized person to receive a cadastral passport. You need to have your passport and the owner’s passport with you.

After all the documents have been collected and an application has been written to the Chamber, you need to pay a state fee of 200 rubles. It will be used to produce a cadastral passport. You can pay this amount at any nearest bank branch, and sometimes there are ATMs or a cash desk on the territory of the Chamber itself.

  1. After this, you need to come to the chamber employee with a paid check. He will check your documents and take your application. Instead of the collected documents, you must be given a receipt confirming receipt of the list of documents. Of course, you don't have to give up your passport. There will be written the deadline for receiving a new cadastral passport or, if necessary, the day when the technician will come to carry out the inspection. You can receive a technical passport within five working days.
  2. On the day that was registered in the receipt, you must visit the Cadastral Chamber again. You need to pick up:
  • previously given documents;
  • a new cadastral passport with a living space plan attached;
  • extract from the register.

You must have your passport and receipt with you. In cases where the cadastral passport is to be picked up by an authorized person, then he must have his passport and a power of attorney certified by a notary.

How long is a cadastral passport valid?

According to the current legislation, it is not established exactly how long a cadastral passport can be valid. Therefore, it can be classified as an indefinitely valid document. However, in order to avoid additional problems or fines, it is necessary to change the passport after each redevelopment carried out, which was officially legalized by the BTI. Also, if you need to make any changes to the registry, then your passport will also have to be changed.

The law stipulates a compulsory inventory, which must be carried out once every five years. However, if no changes have been made to the existing redevelopment, then there is no need to change the cadastral passport.

Changing the cadastral number of a property

The cadastral number contains information about the house, apartment, plot, etc.
In it you can “read” the location region, address and other data. The numbers are not repeated, they are unique. In addition to the obvious information, data on other characteristics is entered into the database: area, number of floors, information about the owner.

As long as no data has changed, the cadastral number remains the same.

If for any reason the property is liquidated, this entails the cancellation of the unique code that was previously assigned. Information about the termination of existence is also entered into the Rosreestr.

When the characteristics of an object change in kind, the cadastral number also changes.

  • The next step is submitting an application with a package of documents to the cadastral chamber.
  • Now all you have to do is wait the due date and receive an updated cadastral passport.
  • But according to the established schedule, the cadastral chamber functions only on weekdays, which means that it will be very problematic for a person working five days a week from morning to evening to submit documents for making changes. That is why on the website of the state register of the Russian Federation it has become possible to also do this action without leaving work, having a computer and the Internet at your disposal.

Methods for changing information in the cadastre

How to make changes to the cadastral passport? This question most often arises before property owners. The procedure must be completed as quickly as possible, since there is a risk of being brought to administrative or even criminal liability due to violations resulting from inconsistency of information about real estate. That is why two main ways have been identified to make changes to the cadastre and register them. The first is to contact the cadastral service directly. In this case, you need to follow a few simple steps:

  1. Step one is collecting and preparing a package of documents. Their list is described in detail and always remains unchanged.
  2. Step two is submitting documents. It is carried out to the cadastral chamber, in person or through a representative. This body must make decisions based on the submitted papers.
  3. Step three – payment of the state fee. It is three hundred rubles according to the law, but may depend on the size of the property.
  4. Step four – obtaining a cadastral passport. The day on which you need to appear for the document will be indicated in the receipt issued when submitting the papers.
  5. Step five – registration. The changes made need to be actually fixed; to do this, it is enough to submit an application to Rosreestr. In this case, you will also need to pay a state fee. It is two hundred rubles for citizens, six hundred rubles for organizations. Registration takes no longer than ten working days.

In addition to personally transmitting documents to the cadastral service, it is possible to submit a package of documents by using the Rosreestr website, which provides an electronic version of the procedure for submitting papers to change the cadastral passport. Several sequential actions are defined here:

  1. Step one - documents. Just like when submitting in person, you need to prepare them in advance, only in addition to collecting everything you need, the papers should be scanned to be uploaded to an electronic resource.
  2. Step two - state duty. It is also paid in the amount of three hundred rubles, and the receipt is scanned along with all documents.
  3. Step three – registration on the site. After this procedure, it is enough to select the command for making changes to the passport and start working.
  4. Step four – filling out the form. We are talking about a statement that is similar to a written version. At this stage, the entire package of documents is also attached by placing their scanned versions.
  5. Step five - notification. The site will notify the user by email that the documents have been accepted and will be reviewed within a certain period of time.

You can only receive a cadastral passport in person or through an intermediary. In addition, even when using an electronic resource, it will be necessary to register changes made.

Is it necessary to change the cadastral passport when changing ownership of land and house?

Hello.

There is currently no such document as a cadastral passport for a land plot.

Due to the fact that the information contained in the State Real Estate Cadastre (GKN) is now considered information contained in the Unified State Real Estate Register (USRN), from January 1, 2020, instead of a cadastral passport, an extract from the Unified State Real Estate Register is issued.

Therefore, if you re-registered the lease to your wife and your lease term was more than a year, then it was necessary to register the lease in the Unified State Register. The fact that the spouse is currently a tenant of the land if the agreement was concluded for a period of more than a year is an extract from the Unified State Register.

Taxes are paid by the owners. Since you are tenants, you only pay rent. See item 2
