What is included in the cadastral passport of a land plot?

Samples of a cadastral passport of a land plot and rules for filling it out

The title document for real estate registered with the cadastral chamber before 2008 will be the “cadastral plan”. According to the law, it has the same legal force as a passport and can be used in transactions related to real estate.

  • The coastal area can only be accessed through the owner's property. In this case, everyone will be able to pass through the site to the reservoir, and his actions will be legal; the owner has no right to obstruct the passage.
  • The land plot is jointly acquired property with the spouse. If there is only one owner of the land plot, the purchase and sale transaction or donation will be impossible without the consent of one of the spouses.

  • Electrical or other utility networks run through the site. Then the owner must provide access to network maintenance personnel and equipment for routine inspection or repair.

Reasons for miscalculations

As practice shows, the most common mistake is the distortion of coordinate data by a cadastral technician on the boundary plan of land plots. Such situations arise for the following reasons:

  • employees of the cadastral state body, when performing technical measurements, use outdated instruments, and also tie a new plot of land to the local coordinate system, while ignoring the state coordinate grid;
  • Many engineers, due to workload or negligence, do not go to the site to carry out all technical procedures and establish coordinate numbers using an approximate method;
  • Some technical employees, due to low professionalism, are not able to set up measuring equipment correctly and accurately make calculations;
  • The human factor comes into play when, due to inattention, the measured data is distorted and an error occurs in the cadastral plan.

Important! Very often, cadastral miscalculation is allowed during the design of demarcation lines of a land plot or its preparation for cadastral work by local government officials.

How to prepare a document correctly?

The more carefully the documents are prepared, the greater the chances that you will not be denied a cadastral passport for the land. As we wrote above, you must fill out the application very carefully.

If you do not know the cadastral number of your plot or it has not yet been assigned (if the plot is not registered), then you must indicate the exact address where the land is located.

preparation of a normative act
Please note that copies of documents must be notarized (if documents are sent via mail or through a trusted person). The power of attorney, if the cadastral passport is issued through a legal representative, must also have the signature of a notary and be valid at the time of filing the application.

As an identification document, you can provide both a passport of a citizen of the Russian Federation and a foreign passport.

As for documents that confirm ownership of land, such documents can be the following:

  • contract of sale;
  • deed of gift;
  • certificate of inheritance;
  • exchange agreement;
  • lease agreement (for example, if the owner plans to buy the leased land from the state).

If the site is not included in the state register, then the boundary plan is not a mandatory document for obtaining a cadastral passport.

However, it is worth considering that before March 2020 it is necessary to complete the land surveying procedure and obtain a cadastral passport, otherwise it will be impossible to carry out any legal transactions with the land.

land surveying procedure
In addition, even now, when selling a plot of land, buyers are very reluctant to consider land that has not been surveyed - they will either not pay attention to it or will offer it at a reduced price. Therefore, we recommend that you carry out the land surveying procedure now in order to be calm in the future and not fall into the land surveying “boom” of late 2017-early 2020, when plot owners will rush to invite specialists to carry out cadastral work. It is expected that in this case the prices for professional services will increase.

The receipt for payment of the state duty is also a very important document. You can pay it either in cash at the cash desk of any bank or through a terminal, or by non-cash payment using a bank card or electronic wallets.

If an application for a cadastral passport is submitted through a cadastral center or MFC, then the receipt is attached to the package of documents, but if you submit a request via the Internet, the system will automatically recognize the payment (the applicant is sent an individual payment code by email).

Mortgages for public sector employees are provided on very favorable terms. In rare cases, a land purchase and sale agreement may be terminated. Read more about this here. Some Russian banks offer mortgages for the purchase of land for the construction of an individual residential building. You can read more about the programs in our article.

Therefore, you should prepare a documentation package in advance, which will include an application for a cadastral passport. This is an important paper, without which you will not receive a technical statement.

In Russia, citizens can receive residential square meters or any real estate in exchange for the maintenance and care of another citizen. The transaction involves the conclusion of a rental agreement. Let's consider what an annuity agreement is, what rights and obligations the parties to the transaction will have, and outline all the conditions for concluding an agreement.

How to obtain a cadastral passport of a land plot

Cadastral passports no longer exist, you cannot order them! The instructions below are not relevant! A cadastral passport is an extract that contains information about real estate from the State Property Committee (State Real Estate Cadastre). In January 2020, the State Property Committee was abolished and merged with the Unified State Register of Real Estate into a new resource - the Unified State Register of Real Estate (USRRN). All data from the State Property Committee was transferred to the Unified State Register. Therefore, instead of cadastral passports, from January 1, Rosreestr began issuing extracts from the Unified State Register of Real Estate. All information about real estate that was in the cadastral passports is now in these extracts from the Unified State Register of Real Estate. How to order these extracts, read the link - https://prozhivem.com/zemlya/documents/kak-zakazat-vypisku-iz-egrn-na-uchastok.html.

All this information is extremely important for property owners. They will be useful when making transactions with allotments: buying and selling, leasing, donating, inheriting. But even simple redevelopment can affect the reflection of information in the passport.

How are cadastral passports for a house and a plot of land interconnected?

After all, he should have in his hands not only a certificate of registration of ownership rights for each object separately, but also a cadastral passport for the house and land plot. Only in this way will the owner be able to confirm his legal rights at any time.

Most often, the developer independently prepares a cadastral passport for the land plot of an apartment building and the building itself with all the apartments located in it. But in practice, it also happens that developers delay the procedure, and then apartment owners have to deal with cadastral registration themselves.

Which premises are non-residential?

Non-residential premises can be considered to be premises in which human residence is not provided, or only non-permanent residence is provided. In the Housing Code, Art. 22 there are conditions on the basis of which the premises can be considered non-residential:

  • the room must be equipped with a separate entrance;
  • there must be no registered persons on the premises;
  • the object should not be an integral part of the residential premises;
  • no third parties should have rights to this premises.

In apartment buildings, non-residential premises are shops, cafes, offices, and so on; stairwells, utility rooms and entrances are common areas. That is, it is worth understanding that the definition of a non-residential object is related to the composition of the building or to the land plot.

How to obtain a cadastral passport of a land plot - sample application

As for the speed of solving the problem, Law No. 221-FZ states that a passport is issued within a 5-day period after the provision of all papers. But, it is important to familiarize yourself with the features of counting the five-day period. If the package of certificates was submitted directly to the Rosreestr office, the countdown begins from the date of their receipt. When the procedure was completed through the MFC, the countdown will begin after the documents are transferred to Rosreestr. Using exactly the same method, you will be able to obtain a copy of the cadastral passport of the land plot.

Here are the basic information that you will need to provide when filling out the application. The procedure will be slightly different if compared with the letterhead provided by Rosreestr or the MFC. In any case, it is important to provide all information correctly. When in doubt, it's best to ask for a sample. Of course, when filling out an application yourself to send by registered mail, you will have to figure it out yourself.
