What is a technical passport

What is a technical plan

Since the beginning of 2013, cadastral registration of each object classified as capital construction has been carried out within the Russian Federation at the state level. The provisions of legal acts are not used in the structure of state technical accounting and technical inventory of capital assets (in accordance with Part 8 of Article 47 of the Federal Law under No. 221-FZ of July 24, 2007 “On the State Real Estate Cadastre”).

To register with the state cadastral register and purchase a cadastral passport, you cannot do without using a technical plan.

The technical plan is represented by a document displaying a specific series of information entered in the State Cadastre, and data on a certain type of capital object (structure, building, premises or object whose construction is not completed).

They are necessary for the purpose of accounting for this object, or data on the share or shares of a similar object, information in a new format necessary for entering it into the State Cadastre.

The contents of the technical passport include graphic and text fragments.

Graphic – depict the data of the cadastral layout of a certain territory or an extract of a certain site from the cadastre; in addition, the location of such a structure, building or object, the construction of which is not completed on the site, is taken into account.

Difference between technical data sheet and technical plan

The regulatory act that came into force in April 2012 states that the technical plan for a property contains a descriptive part of the property directly on the contour of a specific site. A similar procedure is stipulated in the order dated October 14, 2011, No. 577, approved by the Ministry of Economic Development.

Not so long ago, in 2008, Law No. 221 was approved on state cadastral registration, which until today also extended to the land sector.

When Order No. 577 came into force, legislative norms extended to facilities classified as capital construction. This refers to coordinating the turning points of a particular object in order to be able to tie it to a specific piece of land on which it is placed.

It should be noted that today BTI specialists are engaged in maintaining three different registers: a register of land plots, a register of objects classified as capital construction and a register of rights. At the time of 2011, the digitization of the entire list of documentation stored in the archives into electronic format was organized and completed.

This provided the opportunity to create a basis for the cadastre based on previously recorded objects. The whole essence of the work performed and the legislative innovations introduced is to combine these registers in order to create a single one, in the form of a common information system.

The entire result of this combination will be displayed in a document such as a technical plan. A distinctive feature of the technical plan is the binding of coordinates within the area and the placement of housing within the floor of a particular building.

Taking into account the new regulatory act that has come into force, from April 2012 the technical plan for a real estate property must include a satellite photograph, as well as a descriptive part of the property within the contour of the land plot. Such work is carried out by certified and qualified cadastral engineers.

The primary thing in cadastre accounting is the site itself, and the technical plan is recognized for the individualization of a capital object in a given space. In addition, the technical plan must include the technical passport itself.

Let's look at what is the difference between a technical plan and a technical passport for a house (apartment, building and other real estate), and in which cases a technical passport will be needed, and in which a technical plan.

What is the difference between a cadastral passport of an apartment and a technical passport of housing?

In addition to the text, this document has a personal cadastral number: it is assigned to any real estate. Using it, you can see all the information about the apartment, as well as all the transactions made with it. The passport also contains a detailed drawing of the living space indicating the area, taking into account redevelopment if any.

Technical plan and passport of non-residential premises and buildings - what is it?

A technical plan of the premises is needed to register the property for cadastral registration . Without a plan, it will not be possible to conclude any real estate transaction - this document is necessary to buy, sell, or exchange a piece of real estate (Article 24 No. 218 of the Federal Law “On State Registration of Real Estate”).

It is also needed for any redevelopment of premises, commissioning of a new building, or removal of an object from cadastral registration. The document contains graphic coordinates of the object's points and additional information about it.

Until 2013, instead of technical plans there were technical passports . They indicated information about the structure:

  • characteristic;
  • inventory and primary valuation;
  • information about the developer.

Unlike the technical plan, the technical passport did not contain graphic information about the connection of the building to the area or the premises (for example, an apartment) to the building. Technical passports for real estate objects were issued until January 1, 2013 . Now they have been abolished, all information about the buildings is contained in the technical plan.
