An energy passport and thermal imaging examination are almost always required; a conclusion based on the results of selective monitoring of the air exchange rate is slightly less common.

A separate energy passport must be prepared for each building that needs to be put into operation.

The legislative framework

The requirements for the energy passport of a building are established in No. 261-FZ “On energy saving and increasing energy efficiency”, the Urban Planning Code and regional regulations.

Federal Law No. 261

Federal Law 261 “On Energy Saving and Energy Efficiency”, Article 11. “Ensuring the Energy Efficiency of Buildings, Structures, Structures” defines the basic requirements for putting buildings into operation:

6. It is not allowed to put into operation buildings, structures, structures that have been constructed, reconstructed, undergone major repairs and do not meet the requirements for energy efficiency and the requirements for equipping them with metering devices for the energy resources used.

7. Developers are obliged to ensure compliance of buildings, structures, structures with energy efficiency requirements and the requirements for equipping them with metering devices for used energy resources by selecting optimal architectural, functional-technological, structural and engineering solutions and their proper implementation during construction, reconstruction, and major repairs .

8. Checking the compliance of buildings, structures, and structures put into operation with energy efficiency requirements and the requirements for equipping them with metering devices for energy resources used is carried out by the state construction supervision body.

Town Planning Code

Town Planning Code of the Russian Federation, Article 55 “Issue of permission to put a facility into operation”, paragraph 3:

To make a decision on issuing a permit to put a facility into operation, the following documents are required: 6) a document confirming the compliance of the parameters of the constructed or reconstructed capital construction facility with the design documentation, including energy efficiency requirements.

In this case, the supporting document is the energy passport of the building according to the design documentation.

In turn, regional authorities may establish additional requirements for documents for putting buildings into operation.

Order of Glavgosstroynadzor

For example, order of the Glavgosstroynadzor of the Moscow Region dated January 24, 2014 No. 1 “On the implementation of the provisions of the legislation on energy saving and energy efficiency”

1.1. When conducting final inspections of capital construction projects for residential and public purposes, check the complete set of executive and production documentation presented by the developer

  • availability of an energy passport of the building with completed columns of normative, calculated (design) and actual indicators, as well as
  • availability of conclusions based on the results of thermal imaging quality control of the building’s thermal protection and
  • the presence of selective control of the frequency of air exchange in rooms (apartments).

1.2. From February 1, 2014, when considering applications for the issuance of certificates of conformity in relation to capital construction projects specified in clause 1.1 of this order, take into account that

  • the absence of an energy passport of the building or the presence of such a passport with blank regulatory columns,
  • calculated (design) and
  • actual indicators, as well as
  • lack of conclusions based on the results of thermal imaging quality control of the building’s thermal protection and
  • selective control of air exchange rates in rooms (apartments)
  • is the reason for preparing a reasoned refusal to issue a statement of compliance.

How to obtain an energy passport for a building

What is it for?

A technical passport for any type of building is necessary, first of all, to obtain full rights to it and the possibility of carrying out any legal actions with the object, namely:

  • preparation of a contract for the purchase or sale of real estate;
  • conclusion of a lease agreement;
  • carrying out a donation transaction;
  • renting out housing secured by a bank;
  • privatization of property;
  • carrying out reconstruction or redevelopment of the building;
  • technical inventory;
  • for registration of self-built buildings;
  • and other actions with real estate.

When do you need to replace your registration certificate?

Illegal redevelopment threatens with a fine of up to one and a half thousand rubles. Therefore, after demolishing walls or other operations at the site, it is necessary to make changes to the technical passport. There are other reasons for making changes:

  • the building was sold to another owner;
  • there were errors in the passport;
  • the document is lost (stolen).

However, in the latter case, only the entry on the restoration of the technical passport will change. But if the lost passport was issued before 1999, then it should be replaced with a new document. To do this, you will need to bring documents and indicate the loss as the reason in the application.

Regulates the registration of real estate by Federal Law No. 122, which is valid until January 1, 2020. Until then, citizens should be guided by document No. 218-FZ dated July 13, 2015, in which an extensive article is devoted to the technical plan. According to the document, it consists of a text and a graphic part: it must contain a description and drawing of the structure.

After receiving a technical passport, the object must be registered in the cadastral register, after which this property will become the legal property of the owner. Cadastral registration secures the owner's right to real estate. The citizen receives a registration certificate and begins to pay taxes.

As for rented real estate, neither a technical passport nor a cadastral certificate is necessary for it, since a new object is not being created. In addition, no one will be able to officially rent out a house, apartment, or building without an already issued registration certificate.

Technical passport form

The form of the document is fixed by law. Features of filling are as follows:

  1. All characteristics and names are written in full text, without abbreviations.
  2. The address is indicated in full.
  3. The owner of the property must be included.
  4. In case of shared ownership, each citizen is registered and his share is indicated.
  5. The footage of the building and all rooms in it, also attached, must be included.
  6. The date of construction of the property is indicated.
  7. The materials of walls, roofs, and windows are prescribed.
  8. Gas supply, drainage, and water supply are also included in the passport.
  9. The first page contains the date of its creation. It is certified by the signature of the head and the seal of the organization that prepared the document.

How to obtain an extract from the technical passport and what is it?

This is a certificate that contains data from the technical passport. You can request such an extract on the public services portal, Rosreestr or BTI.

Local governments and multifunctional centers also have the authority to request this information. To do this, you need to visit the appropriate organization and leave an application there. You must have documents with you: identification and proof of ownership of the property. In addition to the owner, law enforcement agencies and courts have the right to request this extract.

The certificate or extract includes the date of the inventory, information about the owner of the property, the size of the land plot on which the building is located, the estimated value, the number of floors, information about whether changes were made during the redevelopment, the area of ​​the building, its address, as well as building material , which was used during the construction of the object. Such an extract is valid for one year, and at the same time it is certified by the signature and seal of the organization issuing it.

Any citizen of the country or an organization specialist can request an extract for a property, but only the legal owner will receive a complete certificate.

There are two types of requests: to obtain information based on the results of a building inspection (registration of a deed of gift, inheritance, re-registration, etc.) and to take an inventory of the premises located inside the building (this is current information as of the date of the commission inspection).
