Drawing up and sample of a claim for restoration of the boundaries of a land plot
The claim must be filed according to the following rules:
- Formation of the “cap” of the claim. First of all, you must indicate the name of the court to which the appeal is being made. Next, enter individual information and contact details of the plaintiff (his representative) and the defendant. Often the city administration becomes the responsible party. If a state fee is required for consideration of the claim, its amount is paid.
- Entering the title of the document: “Statement of Claim to Establish the Boundaries of a Land Plot.” It is written in the middle of the line without putting a period at the end.
- Presentation of the main content. Here you should reflect information about the land plot: exact location, cadastral number, information about survey work. Next, you need to indicate where the boundaries were violated and the reasons (grounds) for their restoration.
- References are provided to regulatory articles and laws on which the judge can make a verdict.
- Requirements-requests. For example, a request is made to recognize the information specified in the cadastral plan as erroneous or to establish boundaries between specific territories.
- Attachments are reflected: a list of all documents confirming the incorrectness of the current boundaries of the site, ownership, etc. (certificate of ownership, situation plan, certificate (plan, extract) from the cadastre, act of approval of boundaries, power of attorney, receipt of payment of state duty).
- In the final part, the plaintiff’s signature is placed with a transcript and the appeal is given.
