The queue for receiving a land plot is a certain kind of procedure for providing land to social groups in order of priority.

But the most important introduction of the law is the program to provide young and large families with land ownership.
Based on the program, numerous local regulations were issued, for example, in Moscow and the Moscow region, on the procedure for allocating land to large families based on the adopted changes.
The law is in force as of January 2020, has not been formally repealed and has its own characteristic features regarding the queue for receiving land plots.

Who can get in line to receive a plot of land?
The basic requirements for those who wish to stand in line to receive a land plot are the following points:
- All persons in the family must have Russian citizenship;

- Parents must be legally married;
- All children must be registered with their parents;

An application for the provision of a land plot is drawn up by one person - a spouse.
The statement states:
- The name of the government agency or local administration where the application is being submitted;
- Full name of the applicant and his passport details;
- Mailing address;
- Phone number;
- Text of the request for the provision of a land plot;
- Address of the region where the desired land plot is located;
- Cadastral number of the territory where the land plot is located;

The administration considers the application within 30 days. The terms of land provision vary from 1 month to a year.

In March 2020, a land law was issued, according to which every citizen of Russia has the right to receive a free plot of land from the state for ownership or lease.
During the two years that this law has been in effect, many have been able to become land owners, including us, our friends and clients. If not for the law, this would hardly have happened.
The conditions for the provision of land (paid/free, at auction/without auction, for ownership/for rent/for free use) are determined by the Land Code and regional (republican) laws. Let's understand this issue a little.
There are several legal ways to obtain land from the state.
Below we will briefly look at each of them:
1. Obtaining a free plot of land for rent or ownership by participating in an auction.
In this case, the interested person must independently find a plot that is not encumbered and not registered in the cadastral register.
Any agricultural lands and lands of rural settlements, as well as forest lands for the purposes of their agricultural use (growing fruit and berry plantations, haymaking, beekeeping, gardening) are allowed to be provided for lease and ownership.
The main condition for obtaining land is that the plot you choose is in federal or municipal ownership and is free (not provided to other citizens or organizations).

Next you need to do the following work:
- Write an application for preliminary approval of the land plot in the self-government bodies on whose territory the property is located.
- After approval of the site, an auction is held. Information about it is published in local media and on the Internet 30 days before the auction.
- If there are no more people willing to participate in the auction, the applicant receives the auction protocol and can draw up a lease agreement.
- If the individual wins the auction, he or she enters into a lease agreement for the site with the local administration. The maximum term is 49 years. The rental period is determined individually in each individual case.
Obtaining a free plot of land for rent or ownership without participating in auctions.
This applies to construction sites. When agreeing on the location of the building, the relevant authorities can lease the land without an auction.
To do this, the applicant must:
- find a plot of land yourself;
- write a statement with your request and approval of the location of the future building;
- register the plot of land with the cadastral register,
- provide a boundary plan;
- wait for the decision of the special commission;
- upon approval, enter into a lease or purchase agreement.
The most attractive option in this case is to obtain land lease from the state. In this case, the Tenant has a priority preferential right to purchase the land after the construction of the house and the commissioning of the facility. The maximum cost of such a plot is 2.5% of the cadastral value of the land. In fact, the tenant acquires ownership “for pennies.”

Receipt of land from the state by a large family.
If you are a large family, then at the level of a constituent entity of the Russian Federation a law should be adopted on supporting large families, on the forms of their support and on the procedure for providing a land plot.
The law of the subject should establish the procedure for registering citizens as persons entitled to receive land from the state free of charge into ownership, the procedure for removing citizens from this registration, the procedure for providing citizens with land plots in ownership free of charge, the grounds for refusing this provision, the maximum size of land plots provided to these citizens.
Receipt of land from the state by a preferential category of citizens.
Preferential categories of citizens who, like those with many children, can receive land from the state, are determined at the level of the subject of the federation and at the federal level. For beneficiaries, the same rules apply as for large families.
Categories of citizens who, on the basis of federal or regional legislation, are allocated a land plot on a priority or extraordinary basis also have the right to lease a land plot without bidding. The rules for the provision of such plots, as in the case of their preferential receipt of ownership, are established by federal and regional laws.
Receipt of land from the state for personal farming.
You can take the land you are interested in for free use for a period of 6 years if your region has adopted a law on supporting peasant farming or on the development of personal subsidiary plots.
After 5 years, you have every right to receive it free of charge upon application.
Receipt of land from the state by a legal entity or non-profit organization (NPO).
A legal entity has the right to lease land for the comprehensive development of the territory for the purposes of individual housing construction, for the placement of social and cultural facilities, the implementation of large-scale investment projects in accordance with the order of the Governor of the region, the Government of the Russian Federation or the President of the Russian Federation, as well as for complex development for the construction of a rental house commercial use or for the purpose of construction and operation of a rented house for social use.
A legal entity has the right to purchase a plot also under common property, from a plot received for a summer cottage.
An NPO can receive public plots for integrated development for the purposes of individual housing construction, for gardening, truck farming, and dacha farming.
A peasant (farm) enterprise or agricultural organization is allowed to acquire and lease a plot for the peasant (farm) enterprise to carry out its activities.
