The GKN (state real estate cadastre) stores information about real estate located within the Russian Federation. In what form can I obtain information from the State Property Committee?

Cadastral passport

A cadastral passport is an official extract from the state cadastre, which contains all the distinctive characteristics of a given real estate property, as well as the data required for its registration.

A cadastral passport is required in cases where a notary or other lawyer must conduct a real estate purchase and sale agreement. In addition, this paper is taken when an inheritance or deed of gift is prepared.

Cadastral extract

The cadastral extract contains the most complete information regarding an apartment, house, land plot or any other property. The extent of data that is required to be provided must be determined independently.

All information that must be in the document will need to be indicated in the application for the need to obtain such a document.

For example, data regarding the presence or absence of various restrictions on the use of land or other property is indicated in the section describing its parts. Data related to cadastral value is located in the basic land information section.

A cadastral extract is necessary in cases where legal preparation for the land surveying procedure takes place. Without it, it will not be possible to carry out any cadastral work, since it contains information regarding the coordinates of characteristic points located on the boundaries of the land plot.

As a rule, specialists from cadastral registration authorities collect information for inclusion in the State Property Committee . However, in order to avoid conflicts and controversial situations, in some cases it is possible to involve independent specialists who have the appropriate licenses and permits (for example, the owner has the right to attract an independent appraiser and challenge the cadastral value of real estate).

In Part 1 of Art. 7 of the Cadastre Law defines the characteristics of cadastral registration objects that are entered into the register: the type of immovable object, its cadastral number, address and location, boundaries and area.

The Law also contains a list of additional information about real estate, the inclusion in the register of which is determined by a specific situation, for example:

  • accounting numbers that were previously assigned to the object (inventory, cadastral, etc.);
  • information about encumbrances of rights;
  • land category;
  • cadastral number of the original object from which a new immovable object was formed through division, allotment or restructuring, etc.

Separately, it is worth mentioning the cadastral value of the property - this information serves as the basis for calculating property taxes.

The principle of maintaining the state cadastre, based on the unity of the technologies used, allows us to continuously maintain data up to date and ensure public availability of data throughout the country.

The State Control Committee is being formed into a single state system operating according to uniform standards and in a single legal space.

Information about newly formed objects is also subject to cadastral registration. According to Part 9 of Art. 4 and part 4 art. 24 of the Federal Law of the Russian Federation of July 24, 2007 N 221-FZ, this kind of information is of a temporary nature, which is lost when registering rights to an object; information about the formed objects is not cadastral.

Information is subject to cancellation and exclusion from the cadastre if the rights to the real estate have not been registered within one year or two years (for land plots).

Service result

The information of interest is generated in the form:

  • cadastral passport;
  • certificates of cadastral value;
  • passport extracts;
  • territorial plan.

In addition, the applicant has the right to request copies of documents that served as the basis for entering information into the register. The applicant will receive information as requested - in electronic form or on paper.

The service is provided within up to five working days; when drawing up a territory plan, the period can be extended to fifteen days.

Refusals to provide services are rare in practice, however, this is possible in some cases, for example:

  • the applicant requests information protected by law, but he does not have the right to do so;
  • when an authorized person applies, there is no properly executed power of attorney.

Among the real estate objects there are those for which there is no information in the register; in this case, the applicant will be sent a notification about the absence of data in the State Property Committee.
