Obtaining information from the Unified State Register of Real Estate

The GKN (state real estate cadastre) stores information about real estate located within the Russian Federation. Upon appropriate request to the State Property Committee, you can obtain exact characteristics of the property, information about its area, layout and find out whether changes have been made to it. The extract also contains the date the housing was put into operation.

The Unified State Register maintains a database of rights related to real estate. The authority contains information about the actual and past owners of the living space. Upon request, you will also find out information about previously conducted transactions, the presence of any legal restrictions and encumbrances.

What is GKN

What the State Property Committee is is determined by the decoding - the state real estate cadastre. And the Unified State Register of Rights is a unified state register of rights. The cadastre stores information about property objects of the Russian Federation that is subject to mandatory registration. This includes the technical and general characteristics of the building. The authority provides extracts from the database upon receipt of an application.

The State Register has legal data that has been relevant for housing until now. The collection and entry of information is carried out from the moment the site is put into operation. The registry makes it possible to find out whether the property has been the subject of litigation in the past.

What is the State Tax Code and how to get an extract from it

Information provided

When selling real estate, the owner collects a package of papers confirming his rights to dispose of the property. It includes extracts from the State Property Committee and the Unified State Register of Rosreestr. Government organizations will document the owner’s rights if requests are submitted correctly.

The cadastral extract contains the following data:

  • type of real estate (living space, building, plot of land);
  • demarcation measurements (in cases with land);
  • location on the territory of other facilities;
  • an identification number;
  • date of registration of cadastral registration;
  • total area of the facility;
  • availability and date of redevelopment.

In addition to receiving information from the State Property Committee, a request is submitted to the Unified State Register. The answer to it includes the personal name of the object, information about previous transactions, cadastral and conditional numbers. The area of the property, the actual address, information about the owner, the presence of sanctions and burdensome measures in relation to the site are also indicated.

Differences between cadastral and legal data

The difference between the State Property Committee and the Unified State Register is that the cadastral extract will display all the data of real estate without indicating known information about past and actual owners and financial transactions.

A request for information from the State Property Committee is submitted for the issuance of a territorial plan, technical background information and a cadastral passport. If there is a need for such data, you must remember that this information is stored in the State Property Committee.

An extract from the Unified State Register is characterized by a legal basis that confirms the rights to dispose of real estate of the persons assigned to it as owners. Documents from the cadastral and legal authorities are used to conclude various transactions and agreements in the manner prescribed by law. The need for a certain type of paper arises depending on the type of contract being concluded.

The cadastral registration service proves the existence of the site and displays technical data. And the legal body contains state information about all owners, the presence of which allows you to carry out operations with the site. All certified data on arrests and the existence of restrictions is provided only in the Unified State Register; the individual characteristics of the living space are not indicated.

Important ! The final cost of the extract depends on the requesting party and the type of person who prepared the documentation. You can order GKN information from Rosreestr.

In what form can I obtain information from the State Property Committee?

There are several types of cadastre, because if a certain problem arises related to real estate, one of them may be needed.

Cadastral passport

A cadastral passport is an official extract from the state cadastre, which contains all the distinctive characteristics of a given real estate property, as well as the data required for its registration.

A cadastral passport is required in cases where a notary or other lawyer must conduct a real estate purchase and sale agreement. In addition, this paper is taken when an inheritance or deed of gift is prepared.

A cadastral passport is also taken when drawing up a mortgage agreement. It turns out that the object becomes, as it were, collateral. A cadastral passport is often required in court when disputes arise regarding the ownership of real estate and other issues.

The last moment when a cadastral passport can be requested is to obtain an insurance policy for a residential building built on a plot of land that is also owned.

Cadastral extract

The cadastral extract contains the most complete information regarding an apartment, house, land plot or any other property. The extent of data that is required to be provided must be determined independently.

All information that must be in the document will need to be indicated in the application for the need to obtain such a document.

For example, data regarding the presence or absence of various restrictions on the use of land or other property is indicated in the section describing its parts. Data related to cadastral value is located in the basic land information section.

A cadastral extract is necessary in cases where legal preparation for the land surveying procedure takes place. Without it, it will not be possible to carry out any cadastral work, since it contains information regarding the coordinates of characteristic points located on the boundaries of the land plot.

It will also contain data about the owners or tenants of lands located in the neighborhood. You will most likely have to agree on the boundaries of the site with them. If the problem of land overlapping each other arises, then the issue will also have to be resolved with them. It should be taken into account that the provision of a cadastral extract is carried out on a fee basis.

Cadastral plan of the territory

This is the name given to the thematic plan of the cadastral quarter. This is a rather voluminous document, since it includes two parts at once - a graphical one, which will show the location of the site relative to other land holdings, and a textual one, which in essence is an explanatory note.

In addition, the text part of this paper

Floor plans
has information regarding the area of each plot indicated on the plan, information about their cadastral numbers, where they are located.

The graphic part additionally indicates areas with the location of all communication elements. If this block is located within the city limits, then all buildings, other structures, and all objects that are located close to this block must be accurately indicated.

As a rule, individuals do not request such a document, since in most cases it is required for cadastral work. It is worth noting that it is also available for a fee.

Cadastral certificate about the cadastral value of the property

A cadastral certificate contains data regarding the cadastral number and value of real estate. Based on the information obtained from this paper, the tax on this object is calculated; it is also required in the process of preparing the documents necessary to obtain a loan, inheritance or redemption of this object.

It may be requested by judicial authorities in the event of certain disputes related to this property. The key advantage of a certificate of cadastral value of a property is that it is issued absolutely free of charge.

Copies of documents on the basis of which the information was entered into the State Property Committee

They are usually understood as copies of a boundary plan or technical layout. This also includes a copy of the municipal resolution, and on the basis of such a document permission was issued to change the method of use of the land plot.

These copies include paper as a result of which the purpose of the building or other structure was changed; information about the last owners of the object, its address and location, and so on. You will have to pay money for these certificates.

Documents required to obtain information from the State Tax Committee

An extract from the cadastre is provided only upon presentation of a number of documents:

  1. Passport or other document that confirms the identity of the person requesting the specified information. Instead of the owner, there may be his legal representative. In this case, in addition to your passport, you will have to provide a legally certified power of attorney to fulfill such requests;
  2. Original official request to the State Committee for Taxation regarding the provision of the required data . The form for filling out this document can be found on the official website of Rosreestr. In addition, the form is provided at the offices of Rosreestr, the Cadastral Chamber and the MFC.

To obtain data through the use of limited access, you must present an original or photocopy of paper that confirms the person’s right to access this data.

You will not have to present this document if you plan to order official information containing only the cadastral value of real estate.

Procedure for obtaining an extract

The procedure for completing and submitting documents depends on the place where the request is submitted. The registration chamber, MFC (multifunctional center) or an online portal for the provision of government services will help with this. To obtain information from the Unified State Register, it is enough to present a completed application along with an identification document. A receipt for payment of the fee is attached.

Important ! The government agency provides informational information to various persons. Only a legal representative can access detailed information.

The place where you can obtain a cadastral passport depends on the type of real estate. You can obtain an extract on the condition of residential and non-residential premises from the BTI (technical inventory bureau). A cadastral passport for land is issued only by a division of Rosreestr. It is worth considering that the request must be sent to those branches of organizations that serve the area in question. The passport will be issued within 10 days.

Rosreestr indicates what the State Property Committee of a land plot is. In addition to the technical characteristics, the document contains precise data on the land surveying of the latter. The cadastral passport displays the status of the object: temporary, registered, previously registered, archived or cancelled.

Intermediary organizations provide assistance in completing the request and significantly speed up the process of collecting the required data. Such firms enter into a contract with a government agency or have access keys to protected information. Rush fees apply when using services.

Principles of formation and content

One cannot underestimate the importance of the formation of the State Civil Code, which provides guarantees of property rights, allows for the establishment of reliable borders taking into account the needs of the regions and at the same time guarantees environmental protection and ensures the economic development of territories.

As a rule, specialists from cadastral registration authorities collect information for inclusion in the State Property Committee . However, in order to avoid conflicts and controversial situations, in some cases it is possible to involve independent specialists who have the appropriate licenses and permits (for example, the owner has the right to attract an independent appraiser and challenge the cadastral value of real estate).

In Part 1 of Art. 7 of the Cadastre Law defines the characteristics of cadastral registration objects that are entered into the register: the type of immovable object, its cadastral number, address and location, boundaries and area.

The Law also contains a list of additional information about real estate, the inclusion in the register of which is determined by a specific situation, for example:

  • accounting numbers that were previously assigned to the object (inventory, cadastral, etc.);
  • information about encumbrances of rights;
  • land category;
  • cadastral number of the original object from which a new immovable object was formed through division, allotment or restructuring, etc.

Separately, it is worth mentioning the cadastral value of the property - this information serves as the basis for calculating property taxes.

The full list can be found in Part 2 of Article 7 No. 221-FZ.

The principle of maintaining the state cadastre, based on the unity of the technologies used, allows us to continuously maintain data up to date and ensure public availability of data throughout the country.

The State Control Committee is being formed into a single state system operating according to uniform standards and in a single legal space.

Information about newly formed objects is also subject to cadastral registration. According to Part 9 of Art. 4 and part 4 art. 24 of the Federal Law of the Russian Federation of July 24, 2007 N 221-FZ, this kind of information is of a temporary nature, which is lost when registering rights to an object; information about the formed objects is not cadastral.

Information is subject to cancellation and exclusion from the cadastre if the rights to the real estate have not been registered within one year or two years (for land plots).

Service result

The information of interest is generated in the form:

  • cadastral passport;
  • certificates of cadastral value;
  • passport extracts;
  • territorial plan.

In addition, the applicant has the right to request copies of documents that served as the basis for entering information into the register. The applicant will receive information as requested - in electronic form or on paper.

The service is provided within up to five working days; when drawing up a territory plan, the period can be extended to fifteen days.

Refusals to provide services are rare in practice, however, this is possible in some cases, for example:

  • the applicant requests information protected by law, but he does not have the right to do so;
  • when an authorized person applies, there is no properly executed power of attorney.

Among the real estate objects there are those for which there is no information in the register; in this case, the applicant will be sent a notification about the absence of data in the State Property Committee.
