Why do you need a HOA staffing table?
The staffing table is a document containing information about the number of employees, their positions, salaries and allowances. It is compiled for the annual calculation of financial expenditure.
Using this document, you can accurately determine what amounts are used to pay the working staff, and how many people work in the organization. Based on it, the chairman of the HOA or the personnel officer decide whether annual funding is enough to pay the salaries of existing employees, whether a new position can be added to the staff, and determine how many staff positions the partnership can afford. In Art. 135 of the Housing Code of the Russian Federation, which regulates the activities of HOAs, there is no information about the need to draw up a staffing table.
The Labor Code also does not explain the obligation to maintain such a document. Therefore, drawing up a staffing table is voluntary. Nevertheless, the presence of this document makes it easier to maintain accounting records and interact with the tax and labor inspectorates, and also reduces the risk of errors when calculating salaries. How is the passport office organized at the Housing and Communal Services Administration?
The passport office is, in fact, the same department in the structure of the management company as any other - with the same form of organization, department hierarchy. The desk is headed by the boss; if the volume of work is large, then the department has a deputy, necessarily a senior specialist, and ordinary specialists.
The activities of the passport office of the housing and communal services management company are regulated by current laws, namely Federal Law No. 5242-1 of June 25, 1993, Government Decrees No. 713 of July 17, 1995, PP No. 885 of November 11, 2010, and the Housing Code of the Russian Federation.
Services of a passport officer for a management company
Residents of an apartment building can contact the passport office at the management company and receive the following services:
- Obtain an extract from the house register or apartment card. This can be done by the owner by presenting a passport and a document confirming the ownership of the property (if it is not registered in the apartment). If the tenant is registered in the apartment, only a passport will be enough.
- Register yourself or your children at your place of residence or place of stay or de-register. Documents for these two services can be submitted directly to the passport office at the Criminal Code or through the State Services portal. There are no state fees for these services.
- Obtain a certificate of no debt for utilities. To obtain it, you only need a passport.
under the management company are included in the tariff for the maintenance and repair of common property. That is, for residents of an apartment building, there are no additional fees for processing documents in this organization.
How to temporarily register in housing with “special features”
The described categories of housing are less common than the typical option discussed above - an apartment in private ownership, however, they also have a place.
Municipal apartments
In this case, in addition to the tenant, you will also have to involve the landlord, who checks compliance with living space standards to register temporary registration. If, together with permanent residents, a temporarily registered person receives less than the standard living space, then the landlord has the right to refuse him, which is what happens most often.
A private house
If you want to register in the house, then in addition to other papers from the owner, you will also need to attach the house register.
Mortgage apartment
Until the loan is repaid, the mortgaged apartment is collateral, which means its use and disposal may be limited. To find out for sure whether you can register with it temporarily, you need to refer directly to the contract. Only there you will find the answer to your question
. But most likely, you will be denied registration. In any case, the refusal can be challenged in court, but first it is still better to thoroughly study the agreement: if it clearly states a ban on registration, there is simply no point in turning to justice.
Job description of a passport officer
Every organization has a job description. It defines the basic requirements for a specialist, in our case, a passport officer, and his rights, duties at work, and responsibility.
The legislation defines only general provisions that heads of organizations must adhere to when drawing up job descriptions, including the manager and director. After all, the staffing schedule depends on them.
In particular, it is determined that the passport officer reports to the head of the department, passport office or other head of the management company . Subordination is determined by the organizational structure of the organization.
Requirements
Requirements for a passport officer in a management company:
- knowledge of legislation in terms of acts, instructions, regulations, other normative documents, rules of registration, registration of citizens;
- The passport officer is required to know office work, standards of organizational and administrative documentation, and a unified system for handling this documentation;
- The passport officer must know how the preparation of reference materials should be controlled;
- ability to work with a computer;
- knowledge of labor regulations, internal regulations, labor protection, as well as the basics of fire safety.
At the same time, the management of the management company has the right to set its own requirements for the education of a passport officer .
Responsibilities
It should be noted that the duties assigned to the passport officer are of high social importance. His mistake can sometimes be followed by trouble in the fate of an individual citizen. Therefore, it is extremely important that the passport officer performs his duties responsibly.
Partnership management bodies
To manage the association, HOA members elect a board and its head. Chairman of the partnership:
- ensures uninterrupted operation of house communications;
- establishes relations with the municipality and contractors by concluding contracts for the provision of services;
- works with debtors on the issue of debt repayment;
- prepares budgets and estimates for the next year;
- establishes communication with the population;
- submits reports to the tax office.
The chairman of the partnership makes decisions on the work of the HOA alone. Approval from a general meeting of homeowners is rarely required. For example, with an increase in contributions for major repairs. Decisions made at the general meeting are reflected in the minutes of the HOA. The document is mandatory for public associations.
HOA statistics show that an accountant is also required for the full operation of the association. The audit commission exercises control over the activities of the governing bodies.
If for some reason the chairman could not be elected, then a manager is appointed. The partnership enters into an employment contract with him. The manager is guided by the HOA's constituent document and agreement. In 2020, 32 vacancies were presented on the labor market. Almost a third falls on the Moscow region. The maximum salary of a manager is 56 thousand rubles, the minimum is 14 thousand.
The chairman and members of the HOA board must periodically report to residents. The procedure and deadlines for submitting reports are determined by the charter. Members of the association also have the right to demand information about the flow of money, profits received, payments and expenses of the partnership.
The inspection of the HOA is carried out by an audit commission. It can be initiated by the prosecutor's office or housing supervision. The date of the scheduled inspection is fixed in the charter and housing code. An unscheduled inspection is carried out based on applications or complaints against the HOA of individuals.
It is not necessary to have a staffing table. However, it allows you to streamline the work of the partnership. The document contains information on the number of employees and engineering and technical personnel servicing a residential building, courtyard and non-residential facilities. This includes a lawyer, accountant, passport officer, dispatcher and security guards.
The partnership must maintain a register of members of the association. It displays the personal data of citizens, contacts, and the size of the share of each co-owner.
