Land surveying where to get

⭐ ⭐ ⭐ ⭐ ⭐ Good afternoon, readers of my blog, now we will comprehend the necessary topic for everyone - Land Surveying Where to Get. Perhaps you may still have questions after you read, so it is best to ask them in the comments below, or even better - get advice from practicing lawyers on all types of law from our partners.

We constantly update information and monitor its updates, so you can be sure that you are reading the latest edition.

Obtaining information from a land survey file on someone else's land plot, in particular one belonging to a municipality, is possible within the framework of a court case on the boundaries of land plots. The prosecutor can also make such a request, usually as part of an inspection.

If you need information from the survey file on your land plot, you can obtain it by sending a corresponding request to the Federal State Budgetary Institution “Federal Cadastral Chamber”. This can be done, for example, through the nearest branch of the MFC.

Legal adviser Elena Grigorenko answers:

In order to obtain information from the survey file on the basis on which a plot of municipal land is registered in the cadastral register, it is necessary to make a request through the MFC (multifunctional center) to the cadastral chamber for a cadastral extract of form KV1-KV6. This extract will indicate the grounds for cadastral registration and indicate the coordinates of the site.

Since these concepts are directly related to the preparation of papers that are needed to own land and land plots, and are also a mandatory item in all land transactions (construction, purchase and sale, lease). Therefore, it is worth familiarizing yourself with this terminology, understanding the essence, in order to avoid fatal mistakes.

Cadastral deed: features and procedure for registration

The cadastral file includes many papers that serve as confirmation of the emergence and termination of the existence of a piece of land.
By law, these documents are kept by the relevant authorities. They cannot be removed from the archive or deleted. A case removed from the register is transferred to the archive. The exception includes documents with the status “temporary”. Over time, they acquire the status of “cancelled”, and within 3 years they are destroyed. Cadastral files are supplemented with a cover, stitched and sealed. An accounting file is created after the procedure for registering an application for real estate accounting. A procedure for changes, correction of errors in information, and introduction of new data must also be carried out.

What is the essence of cadastral business? challenging the cost

23.09.2016

In this article we will look at what is the essence of cadastral business? The cadastral file is part of the documents relating to the land cadastre.

Formation of documents and maintenance of a land property cannot be carried out without a cadastral file.

The cadastral case, based on the practice of its consideration, provides for the following documents, which are interconnected:

  • register of the district to which the land of the facility is assigned, the content of which is to conduct mandatory inspections and state registration;
  • cadastre plans (duty maps), which describe the land surveying of real estate, types of buildings and the procedure for determining boundaries;
  • audit and accounting logs in which information about the cadastral number is entered.

Supporting documents also influence the order of use of the building and its storage:

  • accounting journal of documents from the organization’s practice;
  • a protocol of results issued and information that can be requested;
  • a protocol of formation indicating the boundary distribution of the boundaries of the land plot and the procedure for conducting inspections related to it;
  • certificates to the state tax inspectorate, which are provided in cases of request (may be needed when challenging a lawsuit and to determine the results of an inspection of a land plot, as well as its value);
  • the content of the results of real estate accounting, which represents federal, municipal or state property;
  • summarizing the results of statistical studies;
  • generalization of cadastral registration plans (maps);
  • other documents that may take into account the boundary distribution of a land plot or building, the procedure for considering which may be necessary when challenging a court case or in other cases.

From practice, a cadastral file is compiled for any property, for example, a private house, the period for checking the cadastral file is about 1 month.

How to rent an apartment without intermediaries

It also contains a protocol for determining the cost and a package of official documents indicating state registration.

The cadastral package provides all types of documents that take into account the boundary formation of a house or building, which may be needed to determine real estate in the classification system, when challenging a decision in the event of jurisdiction of the case.

Components of cadastral affairs

The cadastral file of real estate or land is compiled for a property that involves conducting economic or other activities. The house must have state registration, documents and an inspection protocol for review and determination of the cadastre number from practice.

If a private house consists of several parts, each of which has its own number, then a separate case is opened for each of them.

This rule is necessary to accurately determine the cost of each component of one object. In the event of a merger of parts of a real estate property, the files on its individual elements are liquidated.

From the results of real estate consolidation, a new case is formed in the cadastre from one object or building.

Any cadastral file contains the following package of papers:

  • a statement indicating the desire to order a cadastre file and its management;
  • a package of papers that are necessary to consider rights to a house, building or other real estate;
  • boundary structure to determine the plan and inspection results;
  • an act indicating that a boundary determination and the formation of a single object were carried out on the territory of the land plot;
  • an extract, which is stored in the state register of cadastres;
  • an extract, which is stored in the Unified Register of Rights to Real Estate;
  • an extract, which is stored in the inventory bureau and from which you can obtain a calculation of the value of a land plot during an inspection or contestation of a case;
  • boundary cadastral business;
  • other papers, the essence of which is to classify a building, site or challenge its value.

Recognition of ownership of real estate through the court

Requirements for preparation of necessary documents

From legal practice it follows that a large number of positive results of cadastral registration are observed if the applicant promptly provided a complete list of papers, the execution of which is regulated by law.

The land survey is the main paper for the cadastral chamber. Jurisdiction of the case will be excluded in the future when challenged if the documents for the house or buildings are properly drawn up.

It follows from practice that determining a decent price for a house can be achieved using only official papers that do not contain corrections, typos or deletions.

The survey case is supplemented with title papers and applications when the case is contested.

Structure of cadastral affairs

Cadastral files are supplemented with a cover, stitched and sealed. An accounting file is created after the procedure for registering an application for real estate accounting. A procedure for changes, correction of errors in information, and introduction of new data must also be carried out.

Cadastral work

This type of work occupies a large part in its field. Activities are carried out according to the laws of the country. It is performed to collect information as well as transmit it:

  • in natural resource management;
  • to state control;
  • for scientific research;
  • to analyze and develop a plan;
  • for unscheduled work;
  • to set prices.

Cadastral work is carried out by specialized companies that have permission to do so.

Principles of cadastral affairs

In order for a plot to have a specific number, the following cadastral documents are required:

  • statement;
  • ownership;
  • site plan;
  • land surveying act;
  • certificate from the Unified State Register;
  • paper from BTI.

The site plan is created by cadastral service employees who have previously been certified. All papers must be submitted in originals.

Composition of the cadastre

The land cadastre includes not only cadastral records, but also settlement plans, which contain data on the boundaries of the territory. It also includes magazines with lists of rooms available in the area. The cadastre includes a register of plots. It includes additional documents: accounting books, tax certificates, lists of state lands.

Land cadastral registration is necessary for every plot. It is considered confirmation of the existence of the territory. Registry work includes:

  • Division. The procedure involves dividing the country's territory to assign a number to each section.
  • Registry number. Each plot has its own number for maintaining the register.
  • Map or plan. The document contains a graphic image with a description.

Each plot must have a cadastral number. The state register contains information about land territories that have already been registered, as well as about those that have ceased to exist. The cadastral file is closed when lands are merged with neighboring plots. After this it is inoperative.

Documentation rules

The cadastral file of a land plot is drawn up for:

  • determining the boundaries of the site;
  • land control;
  • Real estate accounting.

The procedure is carried out by the Committee or the Land Management Department. The first organization draws up documentation for the intended purpose. It involves dacha construction, primary real estate or agriculture. In other cases, this work is performed by the land management organization.

To carry out registration of the primary property, a cadastral file does not need to be opened. And the secondary one needs to create a separate property register. It is part of the CD. Documentation that was previously generated may not be suitable for all items. To resolve this issue, the case is transferred to the certified as per the rules.

Each land plot file has a personal number. It consists of an area code and a serial number, which is recorded in the accounting book. To merge the plots, you need to get a cadastral file again. The land and case numbers are the same. To obtain it, you can use the services of private companies that issue these documents.

Features of land accounting

To carry out cadastral registration, authorities and land rights holders submit an application to companies that perform such work. To do this, title documents for the land and land surveying are required. Everything must be arranged accordingly. For this purpose, documents that contain erasures or additions cannot be accepted.

The application is recorded in the accounting book. Completing the procedure involves checking documents, creating descriptions of plots, assigning numbers, preparing plans and creating cadastral files. Cadastral registration is carried out within a month from submission of the application. After the work, land plans are issued. The registration procedure is completely free. Accounting work is subject to insurance.

The need for land surveying

Cadastral files are opened with the completion of the land surveying procedure. Although, by law, privatization can be carried out without fixing the boundaries of the territory, there may still be many cases when this must be done:

  • to carry out purchases and sales;
  • donations;
  • rental;
  • building a house.

The land surveying procedure will help settle disputes with neighbors when disagreements arise over territories and plot areas. In case of conflicts, the problem can be resolved peacefully, without going to court.

After the document is issued, various transactions can be carried out with land and real estate. Thanks to the availability of the necessary documentation, the plot can be sold, exchanged, or donated.

In this case, all transactions will be legal.

Basic cadastral documentation

16. Special notes. An important point, since here we immediately see whether there was land surveying. In addition, marks are placed here (and sometimes they are forgotten to be placed) about where the property is actually located. With simplified registration (without land surveying), it is impossible to accurately determine in which cadastral quarter the land is located. Therefore, there are often cases when plots are assigned the numbers of other cadastral blocks. Land surveying puts everything in its place, and the corresponding marks about the actual location are placed in the cadastral passport of the land plot.

· B.3 and B.4 - contain information about the established restrictions (encumbrances) on use. For example, a water protection zone or a protection zone of laid communications. If there is no information about such restrictions in the state real estate cadastre (GKN), then these forms will not be given to you when ordering.

Notary or lawyer?

When any disputes or problematic situations arise, citizens doubt who to turn to - a lawyer or a notary. Let us differentiate the capabilities of these two specialists. Notaries are authorized to perform only a narrow range of actions, from certifying contracts, issuing inheritance certificates for land and ending with issuing a power of attorney. Notaries have no right to provide services to resolve a legal dispute, request documents, draw up claims, coordinate land surveying, write petitions, and especially not to participate in court on the client’s side. Therefore, if you are interested in legal representation, contact the lawyers of the public organization “Legal Petersburg”.

Submit your application

What is cadastral business

In order to simplify the processing of applications, it is also recommended to include in the permanent information of the form the attribute “Addressee”, part of the coherent text, and the classification number of the application. As the submitted applications are summarized and analyzed, it is necessary to clarify the content of the text of the applications.

The requirements for the preparation of applications for registration of land plots with state cadastral registration were approved by the Order of Roszemkadastre dated June 13, 2001. These Requirements apply to application forms, the composition of application elements (details), as well as the procedure for their execution.

Main types of land cases

In legal practice, the following types of land disputes are distinguished:

  1. Cases related to the seizure of land for state and municipal needs. For example, a dispute may arise due to non-compliance with the legal approval procedure, non-payment of compensation for a land plot, or an understatement of the ransom amount. Property can be confiscated only in cases specified by law.
  2. Cases related to the provision of plots. For example, violation of the rules for conducting tenders, trades and auctions, illegal refusal to provide a site, etc.
  3. Cases arising from claims of owners. For example, violation of the rights of owners, squatting of plots, obstruction of the use of a plot, increased taxes.
  4. Cases arising from claims by land users. For example, an illegal increase in rent, changing the terms of a lease or perpetual use.
  5. Cases related to the recovery of damages caused by unlawful actions. For example, deterioration in the quality of the land, changing the boundaries of the site, destruction of boundary signs, etc.
  6. Cases related to the recognition of rights to a plot.

Land surveying and where to get it in 2020

Reading time: 3 minutes

As the name suggests, all documentation related to a land development project constitutes a land management document. Collecting a complete package of documents is not always easy. It is formed from strictly regulated legal acts. Let's look at them in more detail.

What is land management

Since land management is documentation and other materials relating to each land management object, the results of land management work are formed into land management.

According to the law, this happens in the following cases:

  • during land acquisition;
  • during inventory of plots;
  • when buying and selling plots and so on.

The above-mentioned concept existed until 2008 and represented the entire process of documentation when registering an allotment for cadastral registration.

It is also worth explaining what land surveying is. It includes the necessary set of data that are taken into account when studying an object and establishing its boundaries. Essentially, this is all the information about the allotment.

The formation of such a case involves carrying out various types of work, in particular:

  • measuring boundaries;
  • determination of coordinates;
  • clarification of the area of the site;
  • restoration and fixation of boundary signs and others on the ground.

What is a boundary plan

Since 2008, the concept of land management has replaced the boundary plan. The prepared document is submitted to the cadastral chamber for registration of the property.

The land survey file must contain the following information:

  • information about the owner;
  • passport details of the owner of the site;
  • the address where the plot is located;
  • information obtained as a result of the work;
  • other necessary data.

During the process of forming the database, all materials are signed by the owners and authorized officials, and then registered in the cadastral chamber.

Who issues documents

Separately, it should be mentioned where the land survey file is kept. The document can be obtained from the cadastral chamber.

Land surveying is carried out by specially trained cadastral engineers. Land legislation defines the procedure for obtaining such a plan. First of all, there is a requirement for mandatory approval of such a process.

It is necessary to agree on the boundaries with all people affected by this type of work: site owners, neighbors and other interested parties.

Employees of the cadastral chamber carefully study the documents provided, on the basis of which a boundary plan is created.

The document is usually issued within 15 days. For its issuance you need to pay a state fee.

The services of a cadastral engineer and the preparation of the plan itself are also paid. The cost depends on the area of the plot.

Composition of land surveying

The boundary plan includes:

  • explanatory note;
  • plan, drawn up in the form of a diagram;
  • technical task;
  • documentation confirming the rights to the site;
  • drawings that make up the technical design;
  • a document confirming the fact of notification of interested parties about the survey;
  • boundary survey report;
  • plan of established boundaries;
  • statement with exact area and calculations;
  • other documentation.

What are development and land use rules

Development and land use rules are an urban planning zoning document that establishes:

  • territorial zones;
  • town planning regulations;
  • the procedure for its application and amendments.

The rules are approved by regulatory legal acts of local government bodies.

The goals of their development include:

  • creating favorable conditions for the development of municipalities and the planning of their territories;
  • ensuring the rights and interests of individuals and legal entities;
  • creating conditions for attracting investment, as well as the possibility of choosing the most effective use of land.

Details are contained in the article “Regulations for development and land use”.

conclusions

The boundary plan, which was previously called land management, is one of the most important documents for cadastral registration of a land plot. The development of the plan is carried out by specialists, and the document itself contains all the significant information about the object.

The plan includes extensive documentation and is drawn up strictly in accordance with the rules established by law. The body responsible for issuing it is the cadastral chamber.

What is cadastral business

For this reason, the unified register contains complete information about both currently existing plots and land plots that have ceased to exist. For example, if two plots were merged, then the final number will be one of the numbers of the merged plots, but the number of the ceased to exist plot is not deleted, but is retained forever.

In this column you must indicate the following information:

  • surname, name and patronymic of the applicant - an individual;
  • abbreviated form of name and OKPO (All-Russian Classifier of Enterprises and Organizations) code for the applicant - a legal entity;
  • TIN (taxpayer identification number), and in case of its absence - identity card details;
  • signature.

Land cadastral affairs

Creation of a cadastral file of a registration object is the final procedure of the State cadastral registration of a land plot in the Unified State Register of Land Registers. The cadastral file number is the cadastral number of the land plot. In accordance with Article 15 of the Federal Law, all documents confirming the fact of the emergence or termination of the existence of a land plot are placed in the cadastral file, on the basis of which the characteristics of the land plot provided for by law are determined.

Economic zones are territories demarcated according to certain rules, located within the boundaries of an administrative-territorial unit, within the boundaries of which the land tax rates, the amount of rent and the standard price of land established by the relevant government authorities apply for land plots and other real estate objects.

Land management (land survey) of a land plot - what is it and where to get it

This process is regulated by the Federal Law of the Russian Federation “On Land Management” (Article No. 22). Having in hand papers that indicate certain boundaries of a plot of land, a citizen becomes its full owner and no one will have the right to cross these boundaries without his consent.

Where is the land survey file kept?

A land survey is a necessary set of information that is drawn up when studying a plot of land and establishing its boundaries.

Such a procedure is important because, based on its results, all the necessary technical documents for the site will be drawn up, without which it is impossible to register it and carry out various transactions.

The process of obtaining a land surveying file is one of the initial stages of registering an allotment and its implementation, hence the need to understand how a land surveying file is formed, where to get it and who to contact?

Essence and content

A land survey document is a set of documents that include all the information about the plot. This type of business is also called land management.

The formation of a land survey involves carrying out various types of work on a site, for example, measuring its boundaries, areas, determining coordinates, and so on.

Land surveying is always carried out exclusively by specialists who have sufficient knowledge and technical equipment for this purpose.

The legislator adopted an act that directly regulates land management, where the details of measuring and establishing boundaries, indicators and coordinates of the site are indicated. Moreover, there are rules and restrictions in this regard.

This law assumes that the area of the territory, which is the main indicator of the site, should not be less than the limits provided for by the regulations. That is, all measurements must be as accurate as possible and contain a minimum error.

If the owner does not have such technical documentation on hand, then he cannot be considered the full owner of the plot.

The survey of a land plot cannot be formalized as a result of the implementation of one of the work options; it is always necessary to carry out a whole range of activities that will form complete information about the allotment.

Such work includes the following:

  1. Creation of topographical plans.
  2. Determination of coordinates, their designation.
  3. Defining boundaries.
  4. Placement of appropriate signs.
  5. Measuring the area of the plot.
  6. Transferring all indicators to paper, drawing up plans and diagrams of the site.

All actions taken must be coordinated with the cadastral service, which keeps records of land plots and issues cadastral passports for them.

In addition to the fact that land surveying allows the owner to freely dispose of his property, the information obtained actually helps to identify the site, record its existence and correlate the plot with other neighboring territories, which is important in order to avoid disputes with neighbors regarding land ownership. Moreover, title documents, which must be in the hands of each owner, can be obtained only after registration, and this is only possible if there is a land survey file for the site.

land surveying

Land management work, which includes a large number of different activities, must be recorded in some way.

That is why the survey file was formed, which has a certain form and structure, requires compliance with the order of presentation of information and its proper execution, otherwise this set of documents will not be considered official and will not be able to help in registering the site and registering it with the land survey service. cadastre.

The main thing when forming a land management case is to avoid violations of the interests of other owners of adjacent plots, otherwise the work will have to be carried out from the very beginning, and on each side of the dispute.

As for the information that should be contained in the survey file, it has certain requirements for its presentation.

The document in question looks like this:

  1. A cover that should contain information about the object, its name and address, and also indicate who is the owner of the plot.
  2. Table of contents of the document for simplified search for specific information.
  3. Explanatory note of the document.
  4. A plan, drawn up in the form of a diagram, which includes information about the site contained in the cadastral service system.
  5. Technical specifications that specialists need for further work on the site.
  6. Documents that confirm the ownership of the site. Only photocopies of such papers are sewn into the file itself.
  7. Drawings that form the technical design of the upcoming work and the plot itself.
  8. Documents that confirm the fact that all interested parties have been notified of the survey work. This is important in the case when the boundaries of the plot are established and the territory of adjacent plots may be violated.
  9. An act reflecting data on the survey of the boundaries that were previously defined on the site.
  10. Powers of attorney of those persons who perform boundary work.
  11. An act that coordinates the established boundaries with those of neighboring areas.
  12. Coordinates that are assigned to each boundary sign installed on the site.
  13. The act of handing over the supporting boundary networks in order of supervision for their safety.
  14. An act recording the fact of acceptance and inspection of survey objects by the specialist performing the work.
  15. Plan of the established boundaries of the allotment.
  16. A statement reflecting the exact area of the site and all calculations made.

All information comes in exactly this order.

The absence of any information will indicate that the survey work was not completed in full, which will not allow the site to be ultimately registered.

A land survey can serve as the basis for both the initial registration of an allotment and, if necessary, making changes to the information contained in the register.

When a land management file is formed, its original is transferred for storage to the archives of the land resources committee. The owner also has one copy in his hands, which he could present without contacting the cadastral authorities when making transactions.

If the owner loses his copy of the file, then he can contact the archive and request a copy of the document.

In order for the case to be valid and serve as a basis for registering the plot of land, the main thing is to include in it all the information about the owner, the plot and the research carried out, recording everything with the signatures of specialists and transferring it to the authorized body.

Surveying process

In order to begin carrying out boundary work, the owner must prepare papers for this. Usually, all that is required is a citizen’s passport and a document that would confirm land rights.

It will be necessary to find specialists who will take measurements and survey the plots.

In such situations, you should contact the BTI (technical inventory bureau), where for a certain fee, since land surveying is a service provided by government agencies, the prescribed measures will be carried out.

The land surveying procedure involves going through several stages, which include the participation of both the land owner and specialists:

  1. Preparatory stage. It is here that the owner collects documents, negotiates with neighbors if necessary, and selects specialists for the work.
  2. Inspection and study of the boundaries of the site, adjacent territories and their features. Designation of existing signs to determine their future fate.
  3. Developing a plan. It will reflect the step-by-step actions of specialists, which will be aimed at obtaining all the important information about the site.
  4. Notifying neighbors and all those who are interested in carrying out this work. Moreover, no work can begin without the participation of the owner himself or without his permission. This is an important rule, since not only the owner, but also another person can order land surveying.
  5. Geodetic survey of the territory and the formation of the obtained data, their processing and full analysis.
  6. Preparation of final documentation. You need to make sure that all papers are signed by authorized persons.
  7. Transfer of the survey file to the cadastre service, which, within about five days, based on them, will draw up and issue to the applicant a cadastral passport, which is an integral part of the technical documentation of any plot.

To carry out all of the above actions, it will be necessary to attract diverse specialists. These are cadastral engineers who carry out measurements and surveys of the territory, and geodetic workers who carry out surveys, and employees of the cadastral chamber.
