To do this, you need to know the rights, functions, tasks, and characteristics of working as a janitor in order to reflect them in the document.

Registration of an employment contract

An owners' association is a separate legal entity that has the right to hire appropriate personnel. In such cases, the job responsibilities of the HOA janitor are prescribed in the instructions and approved by the general council or the board of the association.

The HOA enters into an employment contract with the employee, which takes into account the benefits of both parties. The document describes the responsibilities of management and employees and is the basis for legal proceedings.

Important! The contract can be concluded for a certain period, valid for 1 year - 2 years.

Main sections:

  • general working conditions;
  • list of job responsibilities;
  • operating mode;
  • wage;
  • vacation, sick leave;
  • details, addresses, telephone numbers, signatures of the parties.

Changes to the terms of the contract are fixed in an additional agreement, which is also signed by both parties.

The performer must have the following qualities:

  • diligence;
  • accuracy;
  • politeness;
  • self-discipline;
  • goodwill.

The janitor is given a special working room, it can be a closet in a residential building. Tools, equipment, and materials necessary for work are stored in the room. This is also a place for the employee to relax, since the work involves physical activity.

In case of violation or improper performance of duties by the cleaner, residents of the house have the right to write a complaint to the management organization.

Cleaning the local area of an apartment building in 2019

Not a single person doubts the need to clean the area adjacent to a residential apartment building. However, controversial situations often arise over who exactly is obliged to do this. It is also important to know how often the territory is cleaned, by whose forces it is controlled, and whether the legislation establishes standards related to this process.

What is considered a local area?

Each residential building has an adjacent plot of land nearby. It is considered inalienable and is not considered in a legal sense as a separable entity. The name of this site is the adjacent territory of an apartment building. Let's list what it includes:

  • the land on which the residential building is located;
  • children's and sports ground;
  • parking lot;
  • fire passage;
  • green spaces;
  • other infrastructure and development elements.

Thus, on this site there are various facilities that residents can equally use. The area of the territory, its boundaries and other parameters are determined by the cadastral passport. Based on this data, the cost of cleaning the site is calculated.

Whose responsibilities include

Issues of maintaining the common property of an apartment building are regulated by the Rules that came into force on August 13, 2006.

According to their provisions, cleaning of the surrounding area is carried out by the management company, whose responsibilities include maintaining a specific building.

If the house has a homeowners association, then they independently enter into an agreement with a third-party organization that provides the relevant services. In this case, said company will be held liable for failure to perform cleaning duties.

Janitor's responsibility

So, the agreement clearly and unambiguously describes the powers of the parties. Typically, the cleaner's rights include:

  • require the provision of suitable premises for storing equipment;
  • make proposals to improve working conditions;
  • receive the materials and equipment necessary for work.

At the same time, the contract also specifies the duties of the janitor for cleaning the local area. Of course, it also sets out the scope of his responsibility. It occurs in the event of poor quality or untimely performance of tasks and duties, as well as for non-compliance with safety precautions, service instructions and orders.

Features of work

Every resident should understand what cleaning the local area of an apartment building entails. The list of services is clearly stated in the signed agreement. Along with the mandatory ones, there may also be additional work. This directly depends on weather conditions, the city, its buildings, as well as other factors.

Is a job description required?

The Labor Code of the Russian Federation does not oblige employers to draw up job descriptions. After all, an employment contract with an employee must always disclose his labor function (work according to the position in accordance with the staffing table, profession, specialty indicating qualifications or the specific type of work entrusted to him) (Article 57 of the Labor Code of the Russian Federation). Therefore, it is impossible to hold the employer liable for the lack of job descriptions.

At the same time, it is the job description that is usually the document in which the employee’s job function is specified. The instructions contain a list of the employee’s job responsibilities, taking into account the specifics of the organization of production, labor and management, the rights of the employee and his responsibilities (Letter of Rostrud dated November 30, 2009 No. 3520-6-1). Moreover, the job description usually not only reveals the employee’s job function, but also provides the qualification requirements that apply to the position held or the work performed (Letter of Rostrud dated November 24, 2008 No. 6234-TZ).

The presence of job descriptions simplifies the process of interaction between the employee and the employer on the content of the job function, the rights and responsibilities of the employee and the requirements placed on him. That is, all those issues that often arise in relationships with both existing employees and newly hired ones, as well as with applicants for a certain position.

Rostrud believes that a job description is necessary in the interests of both the employer and the employee. After all, having a job description will help (Letter of Rostrud dated 08/09/2007 No. 3042-6-0):

  • objectively evaluate the employee’s activities during the probationary period;
  • to reasonably refuse to hire (after all, the instructions may contain additional requirements related to the employee’s business qualities);
  • distribute labor functions among employees;
  • temporarily transfer the employee to another job;
  • assess the integrity and completeness of the employee’s performance of his or her job functions.

That is why drawing up job descriptions in an organization is advisable.

Such instructions may be an annex to the employment contract or approved as an independent document.

Cleaning standards

Due to the increased physical activity inherent in this position, the area of the controlled territory is limited and is regulated by the following state legislative acts:

  1. Order of the State Construction Committee of the Russian Federation dated December 9, 1999 No. 139.
  2. Resolution of the State Construction Committee of the Russian Federation No. 170 dated September 27, 2003.
  3. Resolution of the Ministry of Labor of the Russian Federation dated June 24, 1996 No. 38.

In rare cases, local authorities revise established standards, reflecting them in the employment contract with the employee.

The division of the courtyard area according to the level of congestion is taken into account:

  • first class includes traffic capacity of up to 50 people every hour;
  • second level - 50-100 pedestrians every hour;
  • More than a hundred people pass by.

The large number of people makes cleaning difficult, so the area is cleaned early in the morning or late in the evening. The frequency of cleaning depends on the intensity of foot traffic.

Important! An area of 500 sq.m. is usually taken as the norm.

How to draw up a job description

A job description is usually drawn up on the basis of qualification characteristics contained in qualification directories (for example, in the Qualification Directory of Positions of Managers, Specialists and Other Employees, approved by Resolution of the Ministry of Labor dated August 21, 1998 No. 37).

For workers who are hired by blue-collar professions, unified tariff and qualification directories of work and blue-collar professions for the relevant industries are used to determine their labor function. Instructions developed on the basis of such reference books are usually called production instructions. However, in order to unify and simplify internal documentation in an organization, instructions for blue-collar professions are often also called job descriptions.

When drawing up job descriptions, organizations are also guided by professional standards.

Since the job description is an internal organizational and administrative document, the employer is obliged to familiarize the employee with it against signature when hiring him (before signing the employment contract) (Part 3 of Article 68 of the Labor Code of the Russian Federation).

Should the owner pay

The adjacent territory is the property of all homeowners. He talks about this. Legal documents clearly explain that apartment owners, regardless of whether they have privatized their housing or not, are obliged to monitor the cleaning and improvement of the land located near their home.

Since the very placement of a high-rise building assumes that everyone living in it uses the local area, and therefore must service it.

The tariff for cleaning the local area is calculated depending on the total area of the property owned by the owner. This is stated in Part 1 of Art. 158 of the Housing Code of the Russian Federation. In other words, the larger the apartment, the higher the amount its owner will pay for maintaining the land near the home.

IMPORTANT! If the cleaning of the local area is not carried out or is not carried out in full, then the home owner contacts the company and draws up a report. Based on this, the fee for this service will be reduced.

The act states:

  • title: Act on failure to provide cleaning services for an apartment building;
  • date of;
  • statement of the claim: name of the management organization, address of the house, list of claims;
  • Full name, apartment, signature.

You should write as completely as possible what work is not being carried out.
