But, however, before evicting debtors, it is necessary to apply other, less stringent measures to them. According to the Decree of the Government of the Russian Federation No. 354 “On the provision of utility services to owners and users of premises in apartment buildings and residential buildings” dated May 6, 2011 (Article XI), the Criminal Code or DEZ can take some steps to repay the debt only if the “utility » not paid or not paid in full for two months. In this case, it is first allowed to send a written warning (notice) to the debtor’s address about the need to repay the debt within 20 days. If this does not have an effect, then you can proceed to limiting and suspending the provision of utility services, but first, again, you need to warn the consumer in writing that if he does not pay off his utility debts within 30 days, the provision of a particular service may first be limited, and then suspended. And only if this measure turns out to be useless, you can move from warnings to actions, but, however, once again notifying the debtor about this three days before day X - in writing, which is handed over against signature. And we must understand that it is not easy for utility workers to move from words to deeds, since utility networks in apartment buildings naturally supply resources not only to debtors, but also to honest citizens. It is quite easy to stop the supply of electricity or gas, but turning off the water is more difficult; moreover, turning off the cold water supply and heating is not allowed.

However, if these measures turn out to be useless, utility companies have the right to go further and deprive the debtor of not only electricity or gas, but also the apartment if the rent is overdue for more than 6 months. Of course, this is done after a warning and calls to pay, not in two days and only by court decision, but utility services have such an opportunity, especially if the apartment is not owned, but provided to a negligent tenant under a social tenancy agreement. With the owners, everything is more complicated, especially if the apartment is the only one, and there are no known cases of repossession of housing owned by citizens for utility debts. But there are not isolated precedents for terminating a social tenancy agreement due to non-payment of utility bills; they exist both in Moscow and in the regions. In the capital, this practice began in 2006, when the first defaulter was moved from an apartment to a special dormitory in Kapotnya, because it is impossible to put a person on the street - instead of an apartment, he must be provided with some kind of living space according to the standards for the provision of housing (Article 90 of the Housing Code of the Russian Federation ).

At the moment, cases of eviction of debtors are not widespread, this is a last resort measure. After the restriction of services and courts, many defaulters go to settlement and agree to pay off the debt. But when the debt for housing and communal services in a particular area or region begins to grow seriously, the authorities are talking about more stringent measures to combat debtors, including their eviction from apartments. For example, in May 2014, the Ministry of Housing and Communal Services of the Moscow Region advocated for this, when it turned out that the Moscow region’s debt for gas was about 8.5 billion rubles, and the total debt for energy resources exceeded 12 billion rubles.

Moreover, public utility workers would like to evict not only tenants, but also property owners, by creating an appropriate mechanism for this; for example, last spring such a proposal was posted on the website of the now defunct Ministry of Regional Development (“The Ministry of Regional Development does not support the bill on the seizure of housing for debts on housing and communal services”).

Well, in the meantime, the real estate magazine MetrInfo.Ru decided to conduct another sociological study and find out whether residents of the capital know that rent debtors can part with their housing, and how citizens feel about this fact.

It turned out that the vast majority of Muscovites understand that debts to utility companies and energy suppliers can lead to the loss of housing. To the question: “ Do you know that for large debts on rent and utility bills, debtors can be evicted from the apartment? “- 91% of respondents answered in the affirmative and only 9% did not know about such a measure.

In addition, the most representative group of respondents, answering the next question, considers eviction from an apartment for debts to be a completely fair decision; this was admitted by 39% of our respondents. But there were also many opponents of this decision - 26%, and 20% of respondents, that is, every fifth, believe that the fairness of this measure depends on the situation.

But fairness is one thing, efficiency is another. The authorities see the eviction of debtors from apartments as a way to reduce utility debts. However, the majority of Moscow residents – 55% – consider this path ineffective and only 18% of respondents saw economic sense in it.

Opponents of eviction (55%) believe that this measure does not work: “Debtors do not pay for utilities and still live in their apartments,” “few people are evicted for debts,” “there are tenants who do not pay two or three years, and they are not evicted,” and there are also those who “don’t pay at all,” “many people abuse them,” and “nobody wants to deal with them,” because “nobody wants to put effort into this problem,” “no wants to do this." In general, “there is no order in housing and communal services” - how effective is that? In addition, citizens believe that it is wrong to evict all debtors from their apartments: “there may be different cases why a person has not paid,” “maybe he really does not have money or the minimum subsistence level,” and “there is nothing to pay for the apartment.” In general, first “you need to understand” and “approach each homeowner individually,” you should act “based on what the debt is,” understanding that “they may be different.”

Also, a number of citizens consider such a measure as eviction from apartments to be ineffective, because it does not work for everyone: “it’s impossible to evict the owner.”

Supporters of eviction from apartments (18%) for debt are confident in the effectiveness of this measure (although some believe that the effect will not be too great), because “nothing is free” and “you have to pay for everything.” But, it’s true, not everyone should be evicted, but only if “these are malicious defaulters” and “utilities” are not paid for intentionally”: many do not pay because “they have no conscience”, and such people should be evicted “so that others will think” and do not Also.

The majority of the 27% who found it difficult simply refused to answer this question, since they could not formulate their own opinion.

When the survey participants were asked to suggest measures that, in their opinion, should be applied to non-payers, they named those, most of which are already in the arsenal of public utilities: “to sort out the situation in court” (but always in a “fair court”!) and “to evict only after a warning”, “evict to a smaller area” or “in worse conditions”, “impose authorized fines”, “strictly monitor non-payers”, “turn off utilities”, “put on a board of shame” and even “put up leaflets with photos of non-payers in the entrance and in the elevator,” that is, to shame.

Some of the respondents refused to think about measures to combat non-payers, leaving this task to government agencies: “let officials and the government deal with this.”

So, our survey showed that people as a whole do not particularly favor debtors and believe that such behavior should not go unpunished. But respondents defended the poor - those who cannot pay due to their sad financial situation. Therefore, survey participants called on the authorities to carefully examine each specific case. As for such a punishment as eviction, the audience we surveyed does not welcome it at all. But the citizens we interviewed did not offer any universal means of dealing with defaulters, which once again confirms that this is a painstaking and not very rewarding task.

The magazine obtained the data through a telephone survey conducted on a representative sample.
