Exploitation of territories

Many plots that are located outside the boundaries of settlements are provided to the population for agricultural needs. These, in particular, include territories that have a fertile layer. Land for agricultural purposes should be distinguished from areas for agricultural use. The latter are part of the settlement territories and, in connection with this, have a different legal regime.

Agricultural lands are intended to ensure the normal functioning of agricultural production in the country. They, in turn, have their own classification. Thus, there are lands, areas that are occupied by communications and on-farm roads, tree and shrub plantings intended to protect plots from the influence of negative technogenic, natural and anthropogenic phenomena, structures, buildings, structures operated for production purposes, as well as used for primary processing and storage of products.

Construction on land plots of agricultural land

Clause 2 of Article 11 of the Federal Law of June 11, 2003 No. 74-FZ “On Peasant (Farm) Economy” provides for the possibility of constructing buildings, structures and structures necessary for the peasant (farm) economy to carry out its activities in the case of the provision and acquisition of land plots from agricultural lands and lands of other categories. In accordance with paragraph 2 of Article 7 of the Land Code of the Russian Federation, lands are used in accordance with the intended purpose established for them. The legal regime of lands is determined based on their belonging to a particular category and permitted use in accordance with the zoning of territories, the general principles and procedure for which are established by federal laws and the requirements of special federal laws. According to Article 77 of the Land Code of the Russian Federation, agricultural lands are lands located outside the boundaries of a populated area and provided for agricultural needs, as well as those intended for these purposes. Agricultural lands include agricultural land, land occupied by on-farm roads, communications, forest plantations intended to protect land from negative impacts, water bodies, as well as buildings and structures used for the production, storage and primary processing of agricultural products. Agricultural lands - arable lands, hayfields, pastures, fallow lands, lands occupied by perennial plantings (orchards, vineyards and others) - within agricultural lands have priority in use and are subject to special protection. In accordance with paragraph 4 of Article 79 of the Land Code of the Russian Federation, particularly valuable productive agricultural land, including agricultural land, the cadastral value of which significantly exceeds the average level of cadastral value for the municipal district (urban district), may be in accordance with the legislation of the constituent entities of the Russian Federation Federations are included in the list of lands whose use for other purposes is not permitted. Thus, on agricultural lands it is possible to construct buildings, structures and structures necessary for the production, storage and processing of agricultural products. At the same time, to locate buildings and structures for the processing and storage of agricultural products, a land plot (part of it) that is not agricultural land should be used. At the same time, the placement of a residential building on a land plot of agricultural land provided for the implementation of peasant (farm) activities is not provided for by current legislation.
