Types of BTI documents for sale

Participants in the transaction are primarily interested in whether additional papers from the BTI are needed when selling an apartment. If the property will be paid for in cash, you will need to collect a standard package of documents. In this case, the seller must be the legal owner of the apartment. The transaction is completed in the presence of a package of documentation that contains:

  • certificate of right to dispose of real estate (if any);
  • standard purchase and sale agreement;
  • an extract from the Unified State Register confirming the fact of legal ownership of the apartment and the absence of credit obligations;
  • technical passport of the property and other papers from the BTI if necessary;
  • an extract from the personal account and receipts confirming payment for utility bills;
  • owner's passport;
  • certificate of registration.

What documents may be needed from the technical inventory bureau:

  • technical certificate;
  • building plan (if the premises are located in an apartment building);
  • certificates in forms 1a, 5 and 3;
  • explication;
  • statement of inventory value.

Inventory can be secondary or primary. Primary is carried out in new buildings when registering an apartment for technical registration. A secondary inventory is required to process the sale. Its issuance involves taking measurements of the premises by specialists. The information it contains is also used when calculating property taxes.

The explication is not a mandatory document. It is attached to the main package of documents in the event that the buyer doubts the adequacy of the price of the apartment.

Additionally, do not forget about the following papers:

  • If minors are registered in the apartment, you must obtain permission from the guardianship and trusteeship authorities. If there is a spouse, a notarized consent to complete the purchase and sale is taken. If the seller is a trusted person, he is required to provide a power of attorney, previously certified by a notary.
  • In cases where the property being sold is pledged to a lender, it is necessary to obtain a certificate confirming the bank’s consent to the sale.
  • When changing the address of the apartment, the seller will have to provide a certificate of address.

Important! If the property was acquired during marriage, a certificate of its conclusion will be required to complete the transaction.

Therefore, specialists of this organization issue various forms of certificates and documents to citizens and legal entities. The most “popular” are the technical passport for the premises and the explication.

A technical passport is a document that contains all the characteristics of a property. Without this document, no real estate transaction is possible.

An explication is a floor plan of a building, which contains all the characteristics of the property. In addition to these documents, the BTI issues the following certificates: All these certificates and documents are very important! Without them, not a single real estate transaction will take place.   3. cottages;

Most processes carried out in the real estate market require contacting the Bureau of Technical Inventory (BTI).

The validity period of documents required for the purchase and sale of any real estate is a point that is worth focusing on. In practice, a problem-free transaction is achieved through clear planning and an adequate assessment of the situation. And do not forget that all documents necessary for registering a transaction must be valid for both the seller and the buyer.

Almost all transactions related to the alienation of real estate (purchase, sale, exchange, donation, etc.) take a fairly long period of time. This is due both to searching for the second party to the transaction and reaching an agreement with it, and to the need to prepare documents for the alienation.

Some of the documents required, for example, to sell an apartment, have a limited validity period. It is worth taking a closer look at what needs to be prepared in advance, what is the validity period of the documents required to sell an apartment, and how to plan to receive them so as not to ruin a profitable deal.

The only exceptions are those documents whose validity periods are established by regulations of government authorities.

Certificate of inventory value of an apartment from the BTI: where to get it, validity and expiration date

Often citizens are faced with the need to calculate the inventory value of a real estate property. This calculation refers to the estimated value of the living space, which is determined by an appraiser from the public service organization Rosreestr (BTI).

How does the calculation work?

An employee of the Cadastral Chamber makes calculations based on the following indicators:

  • square footage of living space (is the main criterion);
  • availability of utilities;
  • year of construction of the building in which the living space is located.

To obtain information about the inventory value of an object, you must apply to the BTI to provide such information in the form of a certificate, which is issued to the owners and contains data on the residual book value (depreciation of the property is taken into account).

However, starting from the beginning of 2014, the BTI does not prepare such certificates, since the indicator for recalculating the replacement cost, which is used in calculating the inventory valuation, was not established by regulations in 2014. The issuance of relevant certificates is possible based on the status of cost coefficients until the end of 2013.

Why do you need a certificate from the BTI about the inventory value?

A certificate from the BTI on the inventory value of an apartment or any other real estate with such information is necessary for:

  • taking actions to alienate real estate;
  • entry into inheritance;
  • submission to the tax authority when calculating tax deductions on real estate and other government agencies.

The real estate tax, or rather the calculation of its volume, directly depends on the inventory value, a certificate of which you receive from the BTI. The following video will tell you how everything happens:

And continuing the topic of real estate taxes, we recommend watching the following video about ways to challenge the inventory value of a property:

Now let's talk about where and how you can get a certificate of the inventory value of an apartment.

Where and how can I get it

To obtain such a certificate you can contact:

  • citizens (owners and responsible tenants, if housing is municipally owned);
  • legal entities and individual entrepreneurs.

To obtain a certificate with relevant information about the property, you must apply with a certain list of papers at the place of registration of the property. To do this, the applicant must provide:

  • an application filled out in the prescribed form;
  • original passport (photocopies are made of certain pages);
  • title document of the owner or tenant (social tenancy agreement);
  • power of attorney certified by a notary - for representatives (in the original for making a copy);
  • birth/adoption certificate – to represent the interests of minors.

There are several options for completing an application:

  1. in person or through a representative;
  2. through the Internet portal of Rosreestr;
  3. using MFC.

The procedure for applying for a certificate is carried out according to the “one window” principle. The grounds for refusal to issue a certificate may be the following:

  • provision by the applicant of an incomplete list of documents established by the regulations;
  • provision by the applicant of documents that have lost their validity, are incorrectly executed or are not authentic;
  • submission of a power of attorney executed in violation of the established procedure;
  • in case of refusal to pay for services by the applicant or to provide a receipt;
  • if the applicant is not authorized to receive a certificate;
  • impossibility of issuing a document due to circumstances that were unknown at the time of application;
  • if it is impossible to issue a certificate at the request of the applicant within a shorter period established for this type of document.

After receiving the application and the specified list of documents, the employee of the organization sets a date for receiving the certificate. The applicant himself or an authorized representative can pick up the completed document on the appointed day.

Document cost

The document is issued only on a reimbursable basis. The cost of the service is 540 rubles per copy of the document.

Payment for services is carried out by receipt - for citizens, and by invoice for payment - for legal entities. Payment can be made directly at the organization's cash desk or at a bank branch.

paper

The certificate is issued on an approved form, which must contain the following information:

  • number and date of issue of the document;
  • name of the applicant and purpose of extradition;
  • inventory value of living space as of the date of application (indicating the address of the object, its total area); the cost is written in numbers and letters;
  • note (contains information about the presence of encumbrances on the object).

The certificate must be signed by the contractor, as well as the head of the organization, and sealed. And finally, we will tell you about the expiration date (validity) of a certificate from the BTI about the cost of the apartment.

Sample certificate from the BTI on inventory value

Expiration date and production

  • If an inventory procedure is not required before issuing a certificate, then a certificate for one object is issued within 10 days.
  • If a certificate is required in relation to several objects with inventory work carried out, then the time frame for its execution will depend on the duration of the on-site work and the workload of a particular territorial structure. The production time in this case is determined by the agreement signed by the applicant.

As for the validity period of the certificate, it is necessary to talk about its relevance as of the date of the request for specific purposes.

  • So, for example, a certificate for registration of an inheritance in order to present it to a notary must contain current data at the time of the death of the testator and at the date of opening of the inheritance.
  • If a certificate is needed for submission to the bank, then, as a rule, it must be current for the current year.
  • To conclude a privatization agreement, a certificate of the cost of living space for the current year is also required.

In conclusion, we note that the issuance of the document is limited by the period established by the state of cost indicators until the end of 2013 inclusive.

Can the explication and documents from the BTI be valid for longer than 5 years?

The validity periods of BTI documents were abolished on September 1, 2007, when regulation on relevance was introduced. This rule does not apply to documents whose validity periods are established by separate regulations. At the same time, there are internal orders of the MosgorBTI, based on current tasks, plans, federal programs and other processes. For example, the municipal authorities may receive a proposal to conduct an extraordinary inventory, then the documents will lose relevance after changes are made to Rosreestr.
