Temporary registration in Belarus for Russians 2020

Can I check out of my apartment and not be registered anywhere on the territory of the Republic of Belarus?

The legislation provides for several options for deregistering citizens at their place of residence. In relation to your situation, this could be:

Registration on the territory of the Republic of Belarus

1. Change of place of residence within the Republic of Belarus - on the basis of a corresponding message from the registration authority that registered the citizen at the new place of residence. That is, you will be deregistered from the apartment being sold after you register at a new place of residence in the territory of the Republic of Belarus (if it becomes possible to register with relatives);

2. Eviction from occupied residential premises - on the basis of a copy (extract from) a court decision on eviction from occupied residential premises that has entered into legal force. This option is possible if the buyer initially agrees to buy an apartment without deregistering you, and then deregistration will be carried out on the basis of a court decision. The costs of litigation are initially borne by you. This option is unlikely, and the price of the apartment must be too tempting for a buyer to be found for such terms of the transaction.

3. Issuance of a passport of a citizen of the Republic of Belarus for permanent residence outside the Republic of Belarus - on the basis of a notification from the internal affairs body, or a diplomatic mission or consular office of the Republic of Belarus, or the main consular office of the Ministry of Foreign Affairs on the issuance of a passport of a citizen of the Republic of Belarus for permanent residence outside the Republic Belarus. This option is most suitable in your situation. To implement it, you must come to Belarus and submit an application to the internal affairs authorities or contact the diplomatic mission or consular office of the Republic of Belarus at your place of residence abroad to obtain a passport of a citizen of the Republic of Belarus for permanent residence outside the Republic of Belarus (the so-called passport of the PP series '). When issuing a RR series passport, you will be deregistered from the apartment being sold.

4. Termination of citizenship of the Republic of Belarus - on the basis of a notification from the internal affairs body, or a diplomatic mission or consular office of the Republic of Belarus, or the main consular department of the Ministry of Foreign Affairs on the issuance of a conclusion on determining whether a person belongs to the citizenship of the Republic of Belarus, on registering the person’s loss of citizenship of the Republic of Belarus or Decree of the President of the Republic of Belarus on the renunciation of a person from citizenship of the Republic of Belarus.

Thus, you can check out of your apartment and not be registered anywhere in Belarus by implementing one of three possible options.

How can a Russian citizen check out of an apartment in Belarus?

The discharge of citizens of the Republic of Belarus who left the Republic of Belarus without obtaining an extract from their previous place of residence and who remained there for permanent residence is carried out through the Embassy of the Republic of Belarus in the country of residence of the citizen.

For the extract the following is provided: - an application with the citizen’s personal signature, certified in the prescribed manner; — passport or other document according to which it was previously registered; — military registration documents; - house register for private housing or registration cards forms A and B; - three completed departure sheets and 1 statistical coupon for the departure sheet.

Agreement between Russia and Belarus on border crossing

There is an agreement between Belarus and Russia, according to which the following types of documentary identification cards are valid for a foreigner when leaving, transiting and staying in the republic:

  1. National passport.
  2. International foreign document.
  3. Service or diplomatic passport.
  4. Certificate of an employee on a sea vessel.
  5. For minors who are under 14 years of age, a certificate issued at birth is suitable.
  6. Confirmation that a foreign person plans to return to the country of citizenship and travel to a third country - for those who visit Belarus without the purpose of permanent residence with the intention of finding a job and conducting other activities in the country.

Collection and submission of documents

When collecting documents and during the application, it is necessary to take into account the duration of validity of certificates and extracts. Some are valid for six months, and a criminal record certificate is valid for 3 months. The Migration Department is required to consider an application for permanent residence within one, three or six months (the period depends on the reason for the move). The first residence permit is granted to foreign citizens for a period not exceeding two years . Subsequent permits are issued for five years.

However, if the permit was issued for four years, and there is one and a half years left until the passport expires, then the permit will be valid for only one and a half years. After receiving a new passport, you must apply for a residence permit again.

State protection is not provided to the extent that it is provided to citizens of the country. Russians are not given the right to free healthcare. Part of the benefits cannot be applied to them. A driver's license is valid in Belarus temporarily (within ninety days from the date of entry, the license must be exchanged for a national license and the theory must be passed).

Persons with a residence permit are exempt from compulsory military service.

After the expiration of the two-year and five-year residence permits, Russian citizens can apply to migration departments to obtain a Belarusian passport.

Documents are submitted by personal application. In some cases, a seven-year residence period is not necessary: the benefit is provided if the applicant indicates his Belarusian ancestors, outstanding services to the Republic of Belarus, and so on.

To acquire Belarusian citizenship, you need to collect a more complete package of documents. You will also have to provide a birth certificate (or a certified copy), civil status documents, and confirmation of your ability to support yourself. In addition, the documents must be accompanied by confirmation of the renunciation of Russian citizenship or a document guaranteeing the renunciation.

How to discharge a person from an apartment

One of the most popular reasons for expelling a person from an apartment is the purchase of their own home and the associated move. However, in such cases, a citizen changing his place of residence does not oppose being discharged from his previous apartment (house). But it is not so rare that there is a need to expel someone from an apartment without consent. In the Republic of Belarus, this issue is regulated by the Housing Code. In accordance with Articles 85 and 95 of the Housing Code of the Republic of Belarus, you can evict in court without the consent of the person being evicted and provide alternative housing:

Who should register

For all persons arriving in Belarus, a single registration condition applies. According to it, a foreigner is given 5 days to carry out this procedure, except for holidays or Sundays and all dates officially recognized as non-working by the head of the country. Upon arrival, the person must register at one of the responsible departments in the area of future residence. Organizations where registration of citizens is carried out include:

  • Ministry of Foreign Affairs of the Republic of Belarus;
  • Ministry of Internal Affairs of the Republic of Belarus;
  • hotel or hospitality establishment;
  • sanatorium or boarding house;
  • economic enterprise or subject of any direction of agroecotourism.

Valid reasons may include a request for registration or an official request from the receiving party. This rule does not apply to those who do not need to fulfill this condition. Namely:

  • The period of stay of Lithuanians, Latvians and Ukrainian citizens in Belarus without registration can be up to 30 days, and for Russian citizens - up to 3 months.
  • Presidents and senior government officials, members of state delegations and those who visit the republic at the invitation of the president or other authorized government agencies and their families.
  • UN or Interpol employees entering with documents from these structures.
  • Representatives of international structures and organizations aimed at interaction between powers using privileges in accordance with charters and official agreements.
  • Tourists visiting the Republic of Belarus on Saturday and Sunday, on official non-working days, or those who do not plan to stay longer than 120 hours.
  • Commanders and personnel of military aviation transport located in the state in accordance with the officially agreed upon procedure.
  • Employees of flying passenger transport on international air lines or railway transport, if they are located at the points indicated in the route.
  • Military personnel crossing the Belarusian border to conduct joint exercises.

Who doesn't need to pay

State duty may not be charged to foreign guests if the visitor is one of:

  • minors under 14 years of age;
  • foreigners with and without citizenship who have asked for asylum or the opportunity to reside in the country as a refugee;
  • citizens of Serbia;
  • tourists and vacationers in health and resort sanatoriums, staying in hotels for a short period of time and not planning to stay in the country for permanent residence.

Everyone else will need to pay one basic amount in accordance with the procedure established by law.

When traveling to the Republic of Belarus, you cannot expect that registration can simply be purchased on the spot. This procedure is carried out strictly by the relevant authorities, and you can pay for the service, including the state fee and assistance in registration, only by contacting them.

It is also worth considering that when extending temporary registration, the state fee will have to be paid again.

Legal advice on how to leave an apartment

In 2001, an acquaintance registered his son with him. I transferred the personal account to him, and he checked out. Initially, the acquaintance received this apartment under a warrant from the company in 1991. Is the registration legal and if there was a fire (2004), should social housing be issued? hiring (recognized as victims). Thanks for the advice.

I want to divorce my husband because... We haven’t lived with him since March 2010, he checked out and moved to another city, the apartment in which we lived was bought by me before marriage with a mortgage, there are no children together and he has no share in the apartment. I tried through the registry office, they told me that we should come together and write an application, but he does not live in this city. What should I do?
