How to apply for temporary registration through the MFC

Issues of temporary registration at the place of residence are regulated by Art. 5 of Law 5242-1 and other regulations. Officially, this procedure is registration at the place of stay, and it must be carried out within ninety days from the moment the citizen arrives at the place of temporary residence.

Decree of the Government of the Russian Federation dated July 17, 1995 No. 713 and the administrative regulations of the Ministry of Internal Affairs of the Russian Federation (approved by Order No. 984 dated December 31, 2017) provide for temporary registration through the MFC. The composition of the necessary documents for registration is regulated by clause 9 of Resolution 713. List of documents for registration of temporary registration at the MFC:

If the basis for temporary residence is a social tenancy agreement or ownership of the premises, then the applicant may not provide the document itself, but only indicate its details in the application. How much is temporary registration at the MFC and how much does it cost?

The deadlines for temporary registration are established in clause 12 of Resolution 713. In the standard version, the registration authority is required to carry out registration actions. registration is given no more than 3 working days from the date of receipt of the application and other documents. Deadlines

Permanent registration does not have a validity period; temporary registration is issued only for 90 days with the right to re-register for the same period. After this, you need to be discharged or obtain permanent residence.

When contacting the MFC, the registration period will increase due to the need to send requests to other authorized structures regarding registration. In addition to the MFC, registration can be accomplished in the following ways:

  • through the passport office;
  • in the company servicing the house (homeowners association, housing office, housing department, management organization, etc.);

  • when contacting a unit of the Ministry of Internal Affairs performing the functions of an MFC.

Who can act as an applicant to the MFC

Any parent can act as an applicant on behalf of the newborn. The question of whether it is possible to issue a birth certificate to non-parents at the MFC is quite common. Yes, an authorized relative or acquaintance can replace parents: parents must write a letter of application in any form. In addition to information about this person, it must indicate the child’s desired name and patronymic (if the mother is a single mother). To submit documents, the authorized person must present a letter and his passport.

In Moscow and St. Petersburg, applications to the MFC are submitted if the child was born in these cities or if both or one of the parents is registered here.

With only one parent

What to do if mother and father live separately.

Parents can agree among themselves with whom the child will live. In this case, when registering a minor with one of the adults, written consent from the second is not required.

Firstly, registration on living space is of a notification nature, not a permit. Secondly, clause 2.2 of the Order of the Ministry of Internal Affairs No. 984 establishes that the applicant can be one of the parents. If an MFC employee does not accept an application without the consent of the other parent, he must provide a written refusal with reference to the normative act.

This issue is spelled out in the Family Code of the Russian Federation (Clause 3, Article 65). If the mother and father cannot agree amicably, they can draw up an agreement that does not need to be notarized. The main thing is that their signatures should be there. Otherwise, parents can go to court.

Upon receipt of your passport

A minor is considered a person under 18 years of age. However, already at the age of 14, a young man or girl receives a passport. With the onset of this event, the teenager has every right to independently choose his place of residence.

The guarantee of freedom of choice for a minor is:

  • The Civil Code of the Russian Federation (clause 2, article 20), which clearly stipulates that children under 14 years of age live with their legal representatives;
  • Order of the Ministry of Internal Affairs of the Russian Federation No. 984 (replacing the expired Order of the Federal Migration Service No. 288 of September 11, 2012), where paragraph 2 states that the applicant is a Russian who has reached the age of 14 years.

A teenager can independently come to the MFC and register separately from their parents (guardians, adoptive parents). To do this, he must provide:

  • application in form No. 6 or No. 1;
  • passport;
  • consent in writing from the tenant (owner) of the property and adults living with him that they are not against the registration of the applicant.

The result of the service will be a note in the passport about registration at the place of residence or a certificate of registration at the place of stay.

However, if a 14-year-old boy or girl is incapacitated or has limited legal capacity, the issues of registration are resolved for them by their legal representatives.

In public housing

Based on paragraph 1 of Art. 70 of the Housing Code of the Russian Federation, when registering a child under 14 years old with one of the parents in a residential area provided under a social tenancy agreement, the consent of the tenant and the persons living with him is not required. Even if the area allocated to each family member decreases, this is not a reason for refusal.

In a private house

When registering a minor with a parent for living space owned by another citizen, the latter’s consent is not required. Based on clause 2 of Art. 20 of the Civil Code of the Russian Federation, the child must live with his legal representative.

In emergency housing

The legislation does not consider emergency housing as a basis for refusal of registration. A child under 14 years of age can be registered in this living space.

In judicial practice, there are cases where the court has determined that the actions of registration department employees who did not register a child in emergency housing were unlawful.

If a citizen is denied a service or the registration deadlines are violated, he has the right to file a complaint with the management of the unit on the basis of Chapter. V Order of the Ministry of Internal Affairs No. 984. In case of unsatisfactory resolution of the issue, the legal representative may go to court.

What documents need to be submitted to the MFC

Those who do not know what documents are needed to obtain a birth certificate at the MFC should take into account that in addition to the mandatory basic ones - an application, parents’ passports (subject to its conclusion) and a medical certificate of birth (from a maternity hospital or from a private doctor) you may need additional papers.

This will happen if:

  • parents are in a civil marriage. An additional certificate of paternity establishment or a court decision recognizing it will be required;

Who has the right to apply?

According to the law, not only the parents of the baby who was born can apply for a birth certificate. The Civil Code provides a list of persons who have the right to apply for such a document:

  1. Adult citizens, children aged 14 years and older, adults.
  2. Guardianship and trusteeship authorities.
  3. Legal representatives of the child.
  4. Relatives of the deceased citizen.

For each group, there are some nuances for filling out a standard application, but, in general, the procedure is quite similar.

What to do if parents are not married?

Sometimes the parents are not in a marital relationship or the baby’s father is actually absent. In this case, the certificate is drawn up as follows:

  • in case of an unregistered marriage, the father’s data is entered into the birth certificate on the basis of the paternity record;
  • when there is no information about the baby’s father, the mother has the right to indicate the parent’s information at her own discretion or give the child her own surname;
  • if the mother does not want to include information about the second parent in the certificate, then a blank is placed in this column;
  • in case of divorce, when a child was born before 300 days from the date of divorce, the father is considered to be the man with whom the marriage was concluded.

The last rule applies to situations where the marriage is declared invalid or upon the death of the father.

The procedure for obtaining a birth certificate at the MFC

First of all, you should make an appointment in advance. This can be done in person by visiting the MFC and receiving a card indicating the day and time of the visit from the operator, or remotely. This can be done remotely:

The process can be delayed by the absence of a document or a detected error in the parent documents.

It is important to know: the child’s birth certificate received since February 2013 (Federal Law No. 183 of November 12, 2012). Otherwise, it will lose legitimacy and you will have to contact the registry office or MFC to replace it.

What documents are issued by hand?

To obtain a birth certificate, the recipient must present his or her passport. The applicant receives a completed document form with a signature and seal, as well as a certificate F-No. 24.

Refusal to register the birth of a child at the MFC: what are the grounds for this?

In case of refusal of registration, the applicant will be issued a certificate with the reasons for the refusal.

The only reason for an unequivocal refusal to issue a certificate at the MFC may be the foreign citizenship of the applicant. Stateless persons will also receive a refusal.

Citizens of other states and stateless persons will have to apply to obtain a certificate for the child at the registry office.

All other reasons (lack of necessary documents, their inconsistency, errors in filling out forms) will lead to an increase in the period for obtaining a certificate - the number of applications for registration is not limited.
