  • the loan must have been open for more than 12 months at the time of applying for government assistance.

In addition, it is necessary that the citizen meets one of the following conditions:

  • the person for whom the loan is issued has at least one minor child;
  • the borrower is disabled or is raising a disabled child;
  • the citizen is a combat veteran.

Many families will qualify for these conditions if their income has decreased over the past few months or if one of the family members has lost their job. The program will also be useful for large families.

As a rule, in their case it is always possible to receive an income per family member below the threshold value, since the level of the average salary in Russia does not cover the expenses of this category of citizens.

Documents for receiving government assistance

Requirements for the borrower

The state has established criteria by which those wishing to take advantage of the assistance program are selected.

According to government decree:

  • the borrower must be a citizen of the Russian Federation;
  • the total income after repayment of the loan must be less than two subsistence minimums for the region where the debtor lives;
  • Over the past three months, total income has fallen by a third.

Features of full early repayment of debt

In accordance with current legislation, a lender cannot set a fee for early cancellation of financial obligations. This right is enshrined in Art. 809 – 811 Civil Code of the Russian Federation. The earlier version provided that in order to receive targeted government assistance, the average monthly household income for 3 months must decrease by 30% compared to the average monthly value for 12 months.

Restructuring of foreign currency mortgages under the program was possible with an increase in the regular payment by 30% compared to the value of September 2014. The income of co-borrowers was not taken into account in the calculations.

According to the new amendments

In accordance with the amendments made at the end of 2020, the algorithm for calculating household income has changed. To participate in the program, the family budget (all members, taking into account benefits and other income for minors) 3 months before applying for state assistance must be reduced by 30% compared to the total cash receipts 3 months before applying for a mortgage.

For a foreign currency mortgage, the regular payment should increase by 30% compared to the monthly payment on the date of registration of the mortgage. In addition, when calculating the total budget, the official income of co-borrowers is taken into account. AHML has repeatedly noted that co-borrowers must be responsible for the timely servicing of mortgage obligations.

Income requirements for mortgage debt forgiveness

In the first edition, the program provided assistance only to those payers who already had debt. However, in the new edition, the rules have been relaxed and those families who continued to pay contributions on time even after a drop in income can apply for restructuring. This way they manage to maintain an impeccable credit history.

Family income requirements:

  • a decrease in total income over the last 3 months by more than 30%, compared to the same period before applying for a mortgage;
  • with a foreign currency mortgage, the contribution should increase by more than 30%;
  • the balance of funds in the household should not exceed 2 subsistence levels per 1 family member.

When calculating the total budget, it is necessary to take into account the income of all family members, including benefits received for minors. AHML warns that co-borrowers bear no less responsibility for late payments than the main payer.

The mortgage debt forgiveness program does not provide cash. The bank is restructuring the mortgage, and the state will compensate it for lost profits. Legally, the Agency for Mortgage and Housing Lending is a trustee of the state.

Real estate requirements for mortgage write-off

To qualify for government assistance, you must also take into account the characteristics of the mortgaged property. Namely:

  • the mortgaged housing is the only one registered in the name of this citizen;
  • It is not allowed to have more than 50% of other real estate in addition to credit housing;
  • the cost per square meter should not be 60 percent or more higher than the regional average;
  • all mortgage documents must be legally flawless;
  • the area of ​​the apartment should not exceed 45m2 for a one-room apartment, 65m2 for a two-room apartment and 85m2 for a three-room apartment.

Owners of luxury apartments or those purchasing real estate for rental or resale cannot take advantage of government support.

The exception is families raising 3 or more minor children; they can qualify for forgiveness of mortgage debt at any value and class of real estate.

You can only ask for help if at least a year has passed between submitting an application for restructuring and obtaining a loan.

Options for writing off mortgage debt

If the payer meets all the requirements set by the state, he can apply for mortgage restructuring. To do this, a request is made to the bank based on the state program.

In parallel with this, a federal project has been in place since 2011, which makes it possible to write off mortgage debt for a young family. Thanks to it, a young family can have part of their income or the cost of 18 m2 of living space written off when their first or second child is born.

If a family has 3 children during the mortgage repayment period, the state takes full responsibility for paying off debt obligations.

To participate in this program the following requirements must be met:

  • the age of parents should not exceed 35 years (including in single-parent families);
  • the area of ​​the apartment should be no more than 15 m2 per person;
  • the family must stand in line for improved housing conditions, thus confirming that it needs government support;
  • The family’s income must be sufficient to repay the debt (the minimum income for a family of 2 people is 21,621 rubles).

Requirements for existing grounds for debt write-off

A change in family income or payments on a foreign currency loan is not enough to take part in the state assistance program for mortgage holders, which requires additional conditions to be met in terms of:

  • social status of the applicant;
  • ownership of other real estate;
  • area of ​​apartments purchased with a mortgage;
  • period of time from the date of receipt of the loan.

Status aspect

The list of persons who have the opportunity to contact the creditor bank for mortgage restructuring is as follows:

  • parents or guardians of more than one child under the age of majority;
  • combatants with a veteran's certificate;
  • persons with officially confirmed disabilities, as well as those with children with similar signs of limited legal capacity.

The changes made in December 2020 excluded a number of categories of citizens from those worthy of state support, namely:

  • participants in social programs for state mortgage support;
  • government employees and scientific workers;
  • workers for the benefit of the country's defense potential.

Restriction of property rights

The initially imposed restriction was on an area of ​​18 square meters. meters in the mortgaged property, for each household member of the mortgagee’s family, in the current version it has been softened and now, having owned a single apartment, citizens can be co-owners of other real estate objects if their share does not exceed half the area.

Date of loan receipt

In the basic version of Resolution No. 373, only a borrower who was otherwise eligible and had entered into an agreement no later than January 1, 2020 could apply for state support. The current edition has made this parameter floating, limiting not the date of lending, but the period until applying for restructuring , which should occur no earlier than a year after signing the mortgage agreement.

To real estate

There are a number of restrictions that apply to real estate:

  1. The apartment must be of a certain size, which is determined by the number of rooms:
      1 room – 45 sq.m;
  2. 2 rooms – 65 sq.m;
  3. 3 rooms – 85 sq.m.
  4. The apartment must be the only residence . Also, a participant may own no more than half the area of ​​another home.
  5. Real estate should not be involved in legal "shenanigans" . That is, it should not be under an encumbrance, or undergo legal proceedings (read about the removal of encumbrance here).
  6. The cost per square meter should be the average for the area . Cannot exceed the average cost by more than 60%.

Those who participated in military conflicts on the territory of the Chechen Republic and adjacent territories from December 1994 to December 1996 or in counter-terrorism operations in the North Caucasus since August 1999 have much greater benefits.
