To the police

The first step is to file a police report. Why:

  2. An attacker who has another person's passport can use it for fraudulent purposes.

How to make an application correctly?

The document does not have a clearly defined template. Particular attention should be paid to its content. And it should be like this:

Attention: of course, police officers will perform certain actions aimed at finding the stolen property. But you shouldn’t have much hope. Most likely, the document will not be found.

This is the body that deals with issues of migration and issuing passports to citizens of the Russian Federation.

A citizen can submit an application for the need to obtain a new passport:

  • at your place of residence;
  • at the place of stay.

How to find the right structural unit?

Drawing up an application

The order approving Administrative Regulation No. 851 of November 13, 2017, regulating the issuance of a passport, provides for Form 1P, which the applicant must fill out in order to receive a passport.

The document contains the following information:

  1. FULL NAME. applicant.
  2. Place and date of birth of the person.
  3. Family status.
  4. Information about parents.
  5. Location.
  6. Information about previously held citizenship. If a citizen of the Russian Federation is not one from birth.
  7. Information about submitted documents, etc.

Part of the columns is filled out by employees of the Department of Internal Affairs of the Ministry of Internal Affairs. For example, information about inspections.

What papers will be needed?

According to paragraphs 32 - 32.4 of the specified Administrative Regulations, the applicant, in the event of passport theft, must collect the following package of documents:

  1. Theft notification coupon. It is issued by the police upon acceptance of the application.
  2. Application for a passport.
  3. Two photos. The requirements for them are established in clause 38 of the Administrative Regulations. Basic: size 35 by 45 mm, black and white or color, without headdress, full face. If technically possible, photography is carried out in the office of the Department of Internal Affairs of the Ministry of Internal Affairs.
  4. Documents on the basis of which the passports will be marked: marriage, military duty, children, etc.

Important: the theft of a passport, according to the law, is one of the grounds for issuing a new document, therefore the Ministry of Internal Affairs has no right to refuse the applicant.

Obtaining title documents

It is a little more difficult to restore the documents that are the basis for obtaining property. The situation is simplest with contracts concluded in simple written form (purchase and sale, donation, exchange): copies of these papers can be obtained from the archives of the same department of the Federal Service for State Registration, Cadastre and Cartography, and then notarized. Information about equity participation agreements and participation in privatization is also stored there. By the way, if the purchase and sale agreement was drawn up with the help of a notary, then a copy of the agreement can be obtained from him. It is also worth contacting the notary who handled the relevant case to obtain a lost certificate of inheritance.

If the apartment was purchased under an agreement to join a housing cooperative, then you first need to obtain a copy of the certificate of payment of the share contribution, and then restore the agreement through the management of the cooperative.

In addition, one should not forget about some of the subtleties associated with the restoration of documents issued before 1998, when the Law on Registration of Rights to Real Estate and Transactions with It came into force. The fact is that until this moment documents were registered directly, and now transactions and rights were registered, that is, the absence of paper is no longer so important, because the record of transactions with the property is entered in Rosreestr.

However, even papers received according to the old rules do not disappear without a trace - information about them can be found in the archives of the notary who conducted the business. In addition, a certificate from the BTI, which indicates the owner of the property, can help. The most difficulties, according to experts, arise when restoring the purchase and sale agreements that were concluded during the transition period, from 1996 to 1998 (notarial registration was abolished, and the above-mentioned law has not yet come into force). To re-receive the lost papers, you will have to take a copy from the other party to the transaction. It can also be difficult to find old documents confirming kinship. The most problems arise when searching for birth certificates issued during the Soviet era, especially if the desired territory now belongs to another state.

Do I need to pay a fine (state duty)?

As noted, there is no fine for passport theft. The main thing is that the victim has a notification ticket from the police. It is he who will confirm that a crime was committed and the person is not guilty of what happened.

If the passport holder did not contact the police, then he will very likely be prosecuted under Art. 19.16 Code of Administrative Offences. The state fee for issuing a new passport is 1,500 rubles.

How should this be done?

Certificate of ownership - how to get a duplicate

Surprisingly, losing a title deed is not the biggest problem a residential property owner may face. The first thing to do in this case is to contact the department of the Federal Service for State Registration, Cadastre and Cartography at the location of the apartment and write a statement about the loss of documents.

When there is a criminal connotation in the case (for example, burglary), the application must indicate that you prohibit any operations with the missing papers without your presence. The sooner you do this, the less likely it is that scammers will be able to sell your apartment using a fake power of attorney.

If the documents are lost due to an accident (fire, leakage from neighbors above), there is practically no reason to worry. You can obtain a duplicate certificate of ownership at the local registration service office, where all information about transactions and their participants is stored. To do this, you only need to write a corresponding application, present a passport, a title document (sale agreement, certificate of inheritance, etc.), and also pay a state fee of 200 rubles. As a rule, making a duplicate takes from 5 days to a month.

Validity of temporary certificate

A temporary identity card (TIC) in form 2P is issued to a person who has applied for a new passport if he has lost the old one or it was stolen, at his request. That is, by default this certificate, produced on perforated paper, is not issued. The document can completely replace a passport, but only for the time until it is produced.

The desire to obtain a VUL does not need to be stated in writing; it is enough to verbally communicate this to the employees of the Department of Internal Affairs of the Ministry of Internal Affairs. VUL is the same passport, only temporary. The principle of its operation completely coincides with the principle of operation of a passport (except for the cases described below), that is, you cannot be denied any service or demand a full-fledged passport citing the fact that they do not accept VUL.

For example, to establish an identity or to draw up some papers, etc. VUL is the same as a passport. Exceptions:

  1. The right to travel outside the territory of the Russian Federation even to countries that recognize the “internal” passport of the Russian Federation.
  2. VUL is not a document confirming registration.
  3. Cannot be used to issue a passport.

Lost documents in another city

If documents for a car are lost in another city, a special action plan is provided.

In any branch of the Russian traffic police, no matter where a citizen of the Russian Federation applies, only a driver’s license can be restored; everything else is obtained only at the place of registration of the car.

If the papers were lost by a foreigner with temporary registration, this rule will not apply to him. He can apply for reinstatement to the traffic police at the temporary registration address.

In practice, a citizen of the Russian Federation who has drawn up an application for the restoration of lost documents and who has provided an internal passport, if he loses his rights in another city, receives a temporary certificate. A permanent duplicate can only be obtained upon returning home.

When obtaining a temporary license, the driver may have problems if there are accumulated fines. Rights will be issued only after payment!

As for vehicle documents, some problems may arise with them in another city . Restoration of these documents can only be done at the place of registration of the vehicle.

There are two main options here - you can transport the car to your hometown with a special tow truck, which will require serious financial expenses.

An alternative option is to leave the car in a special guarded parking lot, return home to restore documents and arrive in the city where the vehicle was left.

What should I do if the old paper was returned after an application for a new one was submitted?

Firstly, you cannot use your old passport, because it is no longer considered valid. Any use of the document for any purpose may be considered fraud.

Secondly, you must immediately report the discovery to the police. Causes:

  • employees of the Ministry of Internal Affairs will take note that it is not the document itself that needs to be looked for, but the criminal;
  • perhaps there will be some traces on the passport that will help find the culprit of the theft.
