So, for such parking to appear in the yard, it is necessary that at the general meeting of owners the issue is supported by an absolute majority. It turns out that such “closed” parking lots are quite legal. At the same time, all home owners have the same rights to access parking.
Another question is if the fencing of the parking space was an unauthorized decision.
Such seizure of local area can be considered illegal and such actions fall under the article of the Code of the Russian Federation on Administrative Offenses “Illegal occupation of a land plot.”
What to do in this case:
1. Find out who owns the plot of the local area: the HOA or the state? Or maybe a neighbor under the right of a lease agreement.
If the land belongs to the state, you can contact the municipality and quite legally draw up a lease agreement, then the fences will be legal.
If the land belongs to a homeowners association, it is worth holding a meeting of owners to agree on and legally organize parking spaces without infringing on the rights of the other residents of the house. Otherwise, each owner has the right to demand the elimination of any violations.
2. To eliminate fences installed without permission, you must submit a written application to the management company. The application should include photographs, car license plates, all evidence of illegal parking, and indicate your contact information.
Within a calendar month, the department is obliged to respond, investigate and demolish illegal fences.
3. If the Criminal Code does not respond, you can file the same complaint with the city administration and the police.
It is worth noting that for unauthorized occupation of land, the violator faces a fine of 500 to 1,000 rubles, and the violator will also be forced to restore the yard to its original condition at his own expense. In addition, if the road surface was damaged, then the traffic police in accordance with Art. 12.33 Code of Administrative Offenses of the Russian Federation will issue a fine from 5,000 to 10,000 thousand rubles.
A fine is also provided for violation of fire safety requirements regarding the provision of passages, passages and entrances to buildings, structures and structures (from 1,500 to 2,000 rubles).
