Privatization of an apartment through the MFC: all the important points

Sometimes it becomes necessary to contact Multifunctional Centers (MFCs) other than your place of registration, so it is better to clarify in advance what you can do in this case. Since January 2020, the list of services provided to the population through the MFC has expanded significantly.

However, the adopted Federal Law is being implemented gradually according to the approved schedule, so in each region it is necessary to clarify what services are available regardless of the citizen’s registration at the place of residence. Find your nearest center in our directory.

Alimony: what is it? How are they processed and paid?

According to the provisions of the Family Code (FC) of the Russian Federation, alimony is material funds paid by parents for the maintenance of their underage children, and family members - for the maintenance of their needy adult relatives: grandmothers, spouses, adult children, etc.

You can apply for alimony in one of the following ways :

  1. Voluntarily - for this it is necessary to conclude an alimony agreement and have it certified by a notary. In this case, the recipient and the payer independently determine the amount and frequency of payments. In the case of assigning “voluntary” payments, the parties will need to personally visit the notary’s office. In this case, you cannot apply for alimony online through State Services or MFC.
  2. Forcibly - through the court. It is necessary to contact a judicial authority if a parent or other relative refuses to pay child support for their needy family member, and a peaceful resolution of the dispute is impossible. In this case, the funds must be paid exclusively on a monthly basis, and their amount will be determined by the court depending on the circumstances.

You can apply for child support both during marriage (without divorce), and after its dissolution, and also even if the parents have not officially registered the relationship at all.

Where to get a single housing document

If you need any separate document from the thirteen listed, then there are no problems. The required document will no longer be issued by the EIRC, but by the subscription department or passport office (depending on what kind of paper is needed and which department is responsible for issuing it). The competence of the subscriber department includes issuing a copy of the personal account of the owner (tenant) of the residential premises and a certificate of debt for housing and communal services.

The cadastral number can be found from the USRN extract.

What documents should be left on hand after purchasing an apartment after registration?

Documents for registration of new buildings and primary real estate

("primary" - new and old real estate, the ownership rights to which not registered in Rosreestr or until 1998 in the BTI)

-Second - documents on the basis of which ownership will be registered:

  • Share participation agreement and Acceptance and transfer certificate of ownership of the apartment or
  • Documents of membership in the housing cooperative, Certificate of acceptance and transfer of ownership of the apartment
  • Court decision (if there was a trial regarding defrauded shareholders or members of housing cooperatives, etc.)
  • Receipt of payment of state duty (2000.0 rubles for 2020, paid in equal shares for everyone).

Most often, it is necessary to observe the territorial principle of treatment when applying for unemployment benefits for maternity capital after the birth of a second (or subsequent) child, when calculating child benefits, and when placing on a waiting list for a preschool institution (nursery or kindergarten).

This is due to the level of interaction between certain government structures, sometimes it depends on regional programs to provide additional assistance to certain categories of citizens. For example, in various regions, child benefits are allocated from the local budget, which can only be received by citizens registered only in this region.

Who should pay child support?

The law calls one of the responsibilities of parents the maintenance of their children. At the same time, they choose the form and order of this content independently.

But there are cases when children are left without adequate support for their livelihoods. And then the issue of alimony obligations is decided by the court.

In cases of this kind, both the father and the mother can be plaintiffs, as well as defendants. That is, it is possible to impose the obligation to pay alimony in court on both spouses, the main thing is that their children have not yet reached the age of majority.

According to the Family Code, payments can be made after adulthood, in cases where children have disabilities or become incapacitated after 18 years. In this case, the parents are required by law to pay child support, the amount of which is established by a court decision.

Also, elderly parents have the right to apply for monetary compensation through the court if they are recognized as partially or completely incompetent, when the amount of their pension is less than the subsistence minimum.

Registration of benefits for a child under 18 years of age at the MFC

When parental leave has ended, and with it the period for receiving financial assistance from the state, parents can collect documents and ask government social protection agencies to accrue benefits until the child reaches 18 years of age. This payment is regional, so the procedure for calculating it is regulated by local laws. Benefits are provided only to low-income families.

Initially, payments are accrued until the age of 16, but if the child continues to study in a general education institution on a budgetary basis, then benefits will be paid until adulthood.

Documents for child benefits up to 18 years of age

Submission of documents to the MFC is carried out by appointment. The standard documentation package includes:

  • statement;
  • originals and copies of parents’ passports;
  • child's birth certificate;
  • if the child is over 14 years old, then his passport;
  • a certificate confirming the child’s residence with his parents;
  • a certificate of income of all family members for the quarter;
  • document from the educational institution confirming training.

The MFC registrar will accept the documents, check for compliance with legal standards, issue a receipt for receipt of the papers, which can be used to track the status of the application. Next, the specialist will send the papers to the USZN for review. Social authorities defense is authorized to approve the accrual or refuse the payment of benefits.

The refusal must be legally justified and presented in writing. An unlawful decision should be appealed in court.

Benefit amount

The amount received can vary from several hundred rubles to several thousand. The calculation is based on the regional cost of living for children.

How is child support paid?

The basis for the fulfillment of alimony obligations is a writ of execution. On its basis, the amount specified in the court decision is withheld from the income of the person working and paying alimony, which is transferred to the account of the person receiving alimony within three days following the accrual of wages.

There are situations when the person paying alimony works outside our country. Under such circumstances, their payment is possible both in rubles and in any other currency.

Funds are transferred into national currency at the rate set by the Central Bank of Russia. When transferring money, the rate determined on the day the alimony is collected is used.

In the same way, military personnel who are temporarily located in the territory of another country must fulfill their alimony obligations.

Is it possible to get a passport at another MFC?

And also on January 19, 2020, D. Medvedev signed order No. 43-r, which spells out all services provided on an extraterritorial basis. The document can be found here.

This Law provides that in the country, regardless of the applicant’s place of residence, it is possible to submit an application for the provision of services to any unit of the relevant executive authority, state extra-budgetary fund or multifunctional center.

This legalizes the principle of extraterritorial services for citizens who can contact the MFC and submit documents for registration in a region other than where they are registered at their place of temporary or permanent residence, that is, not by registration.

What you need to do to receive child support

To issue alimony means to receive a writ of execution and transfer it to the bailiff, to the organization where the payer receives income. The executive document is drawn up in one of the following ways:

Voluntarily

This procedure involves concluding an agreement with the former spouse (Articles 99, 100 of the RF IC). The document will stipulate the procedure for paying alimony, the method of transferring money, the amount of monthly deductions, and the penalty for failure to fulfill obligations.

A document acquires the force of a writ of execution only if it is notarized.

If the children in respect of whom the agreement applies have reached the age of 10 years, their presence at the conclusion of the agreement is mandatory (Article 57 of the RF IC).

When contacting a notary, you must have with you:

  • passport (for both parties);
  • birth certificate of a minor or other document confirming paternity;
  • documents confirming the payer’s income level (for example, a salary certificate);
  • bank account or card details for transferring alimony.

Executing an agreement via the Internet is impractical and impossible. The personal presence of the parties and the notary is required.

Forcibly

Alimony is issued in the order of writ or claim proceedings. In this case, the potential alimony recipient will have to go to court - file an application for a court order or a claim for the collection of alimony.

The reluctance to go to the courts forces us to look for alternative ways of interaction, and they exist.

The opportunity to file a claim electronically appeared thanks to the Order of the Judicial Department at the Supreme Court of the Russian Federation dated September 11, 2017 N 168, according to which anyone can register, enter the personal account of the State Automated System “Justice” system and send the necessary documents to the magistrate. According to Art. 3 of the Code of Civil Procedure of the Russian Federation allows filing a claim in electronic form.

To formalize a gift agreement, the share must be allocated and changes must be registered in Rosreestr. Only in this case will it be possible to give it to another person. The consent of the other owners is not necessary - they are only subject to the right of first refusal when selling real estate. By virtue of Part 1 of Art. 42 of the Federal Law of July 13, 2015 No. 218-FZ “On State Registration of Real Estate” transactions for the alienation of shares in the right of common ownership of real estate are subject to notarization, with the exception of transactions in the case of alienation or mortgage by all participants in shared ownership of their shares in one transaction. Thus, the agreement of donation of a share in the right of common property is subject to notarization. Through government services or the MFC, such a transaction will not be registered for you without a notarization.

Applying for alimony through the MFC

Since 2020, Multifunctional Centers have been accepting applications for alimony. You can also apply for divorce at the center's branches.

Attention! Both mother and father can act as payer, it is important that the child is under 18 years of age. If he has reached the age of majority, but has a disability, the parents are obliged to pay child support ordered through the court. If the cost of living of elderly parents is less than the pension, they have the right to file an application for monetary compensation in court.

Is it possible to apply for alimony through the MFC?

Many recipients of alimony (most often these are mothers of minor children) are wondering: how to apply for alimony to the court through State Services, at the MFC or via the Internet?

At the moment, it is not possible . However, the Ministry of Economic Development has prepared a draft reform, thanks to which MFCs will provide absolutely all types of public services, including accepting claims for alimony payments.

Today, a future recipient of alimony can still contact the MFC at the stage of collecting documents. At the multifunctional center you can obtain a certificate of family composition , which is necessary to file a claim for the recovery of child support. This certificate is needed to confirm the fact that a minor child lives together with the claimant.

It is important to note that in 2020, not all MFCs in the country can obtain this document. For example, you can contact the branches of Moscow and St. Petersburg without any problems, but in the Bryansk region the centers do not issue certificates of family composition. You can obtain up-to-date information about the services provided on the websites of regional branches of the MFC, as well as by calling the telephone numbers indicated on them.

What you can find out about alimony through the MFC

If documents for alimony have been filed and enforcement proceedings have been initiated, through the MFC you can obtain information: when the enforcement proceedings were initiated, who is handling the case, the amount of debt. Information is provided by the Bailiff Service.

Be sure to read it! Voluntary relinquishment of parental rights

Is it possible to apply for alimony through the MFC in all regions of the Russian Federation?

Parents have the right to apply for child support through the MFC portal, but this opportunity is not provided to all residents of the Russian Federation. Not all areas of the judiciary are connected to the electronic document management system. In this regard, the judge will not have access to the submitted applications.

On a note!

Residents of large cities have the opportunity to submit an application through the MFC website. In settlements with a relatively small population, the service is not always supported due to its high cost.

To check whether the service is available in a particular city, you need to go to the government services website. After selecting a city, the number of operations that can be performed by yellows of this locality through the portal will be available.

If the method of submitting an application via the Internet is not supported in a particular locality, you need to go to the MFC branch. There are such centers in almost every city. The response to the applicant is sent in writing after studying his package of documents.

Registration of benefits at the MFC in case of non-payment of alimony by the father

There are often cases when the payment of alimony for minor children has already been assigned , but the payer avoids fulfilling his obligation. alimony debt begins to form and accumulate .

If the child's mother (or father) is low-income, she is entitled to increased child support due to non-receipt of child support. The size of payments, frequency and duration of their receipt are regulated by the subjects of the country. This means that in different regions the size and conditions for receiving benefits may differ.

However, there are general conditions for receiving increased benefits:

  1. The recipient of alimony is low-income - this means that the average monthly income for each family member does not exceed the subsistence level.
  2. Alimony is collected on the basis of a writ of execution or a court decision .
  3. The alimony payer does not provide financial support to the child.
  4. The alimony worker has already accumulated an impressive amount of debt : on average, about six months.

You can apply for benefits both to the social security authorities and to the MFC. It is necessary to provide government employees with the following documents :

  1. Application for an increased benefit for a minor.
  2. Child's birth certificate.
  3. Confirmation of the child’s cohabitation with the benefit recipient: for example, a certificate of family composition.
  4. A certificate of income for each family member is necessary to confirm need.
  5. Depending on the circumstances, documents confirming the fact of non-payment of alimony:
      a certificate stating that the location of the debtor has not been established - it can be obtained from the Bailiff Service;
  6. information about the location of the defaulter: from a medical organization (in case of compulsory treatment), from a place of imprisonment. Additionally, you will need to attach a certificate stating that the payer does not have sufficient income to pay alimony;
  7. information that the payer is undergoing military service can be obtained from the military commissariat.

The list of documents can be expanded depending on the region of residence and the circumstances of receiving increased financial assistance from the state. Information about the possibility of contacting the MFC in a specific region can be clarified by calling the multifunctional center.

What documents can be issued at the MFC?

Dear readers! Our articles talk about typical ways to resolve legal issues, but each case is unique.

If you want to find out how to solve your particular problem, please use the online consultant form on the right or call. It's fast and free!

Using MFC services helps many citizens speed up the registration process. The MFC allows you to quickly and without long queues process most documents, while applications for certificates can be sent electronically, later providing the originals of the necessary documentation.

Multifunctional centers are located in almost every region and have the right to provide a large number of services. However, the disadvantage of this registration is the need for a longer waiting time for the required type of certificates.

Multifunctional centers are aimed at facilitating the work of other government agencies. Clients can process a large number of documents using the MFC.

The most common include:

  • change of driving documents;
  • replacing a passport photo;
  • obtaining a foreign passport;
  • obtaining an insurance policy;
  • obtaining a death certificate;
  • obtaining a birth certificate;
  • certificate of divorce;
  • registration and deregistration;
  • SNILS certificate;
  • registration of documents for real estate.

Let's celebrate! The essence of the work of such centers is that a person does not need to obtain certificates from various authorities; all necessary documents can be submitted and completed by contacting one specialist.

Do I need to pay to receive services at the MFC?

A visit to the MFC is a service that does not require the payment of any financial resources, unless this is provided for by law.

In cases where a multifunctional center specialist demands payment for the provision of services for the preparation of a particular document, this is considered a violation of the law and is subject to punishment.

Free services

MFCs provide the following types of services free of charge:

  • informing clients on issues of interest;
  • submitting applications to obtain the necessary documents;
  • documents receiving;
  • receiving municipal services;
  • obtaining tax certificates;
  • extracts from Rosreestr;
  • certificates from the Pension Fund;
  • extracts from bailiffs;
  • obtaining a birth or death certificate.

Note! Almost all types of services are absolutely free and can be obtained on a first-come, first-served basis after providing the necessary types of documentation.

Paid services

When contacting MFC organizations, you must pay a fee for the following situations:

  • if obtaining documents requires payment of a state fee;
  • for cases where the document received requires payment according to legislative procedures;
  • if necessary, get the service urgently. Most often, obtaining the required service can take from 2 weeks to 1 month, depending on the complexity of the procedure;
  • printing photographs on documents.

Let's celebrate! Also, a fee is charged for the provision of services that require the mandatory payment of funds, without which the documentation will not be accepted by other authorities. Payment is made only through the cash register; many MFCs provide bank tellers for the convenience of making payments.

How to prepare documents at the MFC?

In order to obtain the necessary services, you must perform the following algorithm of actions:

  • visiting a multifunctional center located at the place of registration of the citizen;
  • writing an application for the required type of service;
  • payment of state duty (if necessary);
  • provision of necessary certificates and their copies;
  • receiving a notification indicating the list of certificates provided and the date when you need to visit the MFC branch;
  • on the appointed day, the citizen must come and present identification documents and receive the necessary documentation.

Note! In cases where, for some reason, the terms for providing the service are increased, the citizen will be notified by MFC employees by phone.

Sign up for an electronic queue to visit the MFC

Many citizens face problems of long queues to obtain the necessary certificate.

MFC branches are aimed at eliminating such problems and also work with clients online. This procedure is carried out according to the following algorithm:

  • a person must go to the official website of the MFC;
  • on the main page, select the “Electronic Reception” tab;
  • go to the link to book an appointment online;
  • In the window that appears, you must select the address of the MFC, which is located at the place of registration or at a location convenient for the client;
  • in the column that appears, you must indicate the person’s personal data and contact phone number for further communication. Confirm in a floating window that the person is not a robot;
  • in the window that appears, you need to mark the service that interests the person;
  • After clicking the “forward” button, free dates for visiting the center will appear, determined automatically. After specifying the date and time, in a few minutes you will receive a notification about the processing of the application and the result received;
  • on the appointed day, the citizen must come to the MFC branch with the necessary certificates. In the administrator's window, indicate that the application was sent through the official website and provide identification documents. All these services can be obtained in one place - in the multifunctional center. Similar organizations appeared in Russia recently, for the first time in Moscow, and now they exist in many parts of our country, and their number is growing.

For your information

The functions of the MFC are limited to contacting municipal and state authorities upon a visitor’s request for necessary documents, and, on the basis of current laws, issuing the requested documents.

What is MFC?

MFC is a “one-stop shop” service that provides the Russian population with various services from state and municipal organizations within a city or country. The applicant requests the documents he needs not to the municipal authorities, but directly to the center’s specialists. They send requests for the issuance of necessary state-issued documents to municipal authorities. The time frame within which this service will be provided to the citizen is determined. He is notified about them, and at the appointed time comes to the MFC for the finished results of the documents.

The purpose of the MFC is:

  1. Provide the population with the opportunity to receive various government services in one place.
  2. Implement interdepartmental coordination of government agencies.
  3. Reduce the burden on state and municipal authorities to provide assistance to the population.
  4. Minimize the time it takes for citizens to respond to requests.
  5. Give them the opportunity to monitor the preparation of the necessary documents and inform them about the activities of the center.

Additional information
There is an Internet portal called State Services, where you can find out where to go for certain questions. And there are multifunctional MFC centers where specialists will provide complete information, process personal data, and prepare documents within the specified time frame. Interaction with state and municipal authorities takes place without the participation of the applicant.

Who can draw up documents at the MFC?

How to check readiness?

The applicant submits documents to the MFC according to the list provided by the center’s specialists, and receives the result within the established time frame. After submitting an application for the service, a receipt is issued with a list of documents submitted and indicating the number (if it is not specified, you should definitely check with the center employee), by which you can track what stage of readiness the registration of the requested papers is at (foreign passport, SNILS, how the review is progressing applications for maternity capital, etc.). You can do this:

  • by contacting the hotline of the center of your region by phone;
  • on his official website;
  • contact the specialists in person with a receipt, but not earlier than the deadline indicated in it for the execution of the application;
  • on the support chat of the MFC website (not everywhere there is such a site).

Additional information
Some MFCs send SMS messages to their clients about the readiness of documents.

The applicant can receive the documents in person upon presentation of a passport and receipt, or by a power of attorney certified by a notary for a representative.

Nuances of processing documents at the MFC

There are some differences in the preparation of documents in this institution and directly in municipal organizations. As is known, the center is an intermediary between them and the applicant. General stages of registration of services:

  1. The package of documents required is the same.
  2. The same amount of state duty.
  3. There is only one application form.
  4. A receipt will be given both there and there.
  5. Pre-registration is available online.

Differences in the work of the MFC:

  1. More convenient work schedule (from 8:00 to 20:00, Saturday is a working day).
  2. There is an ATM where you can pay the state fee (one paid elsewhere is not accepted, as the details are different).
  3. The center’s specialists will make free photocopies of documents for submission.
  4. The deadline for the preparation and provision of documents in a “one-stop shop” organization increases by several days, since it takes time for delivery from the organization that issues them.
  5. It is not always possible to get a free consultation, since the center’s specialists are not familiar with all the nuances of processing certain transactions (for example, real estate).

Let's look at the example of real estate registration. When applying to Rosreestr, you need to collect the same package of documents, pay a state fee in the amount of two thousand rubles plus 400 rubles for a paper registration certificate and 250 rubles. on electronic.

Additional Information

To reduce the time spent on obtaining results, you should familiarize yourself in advance with the procedure for processing the necessary papers and documents, submit the entire package, so as not to repeatedly apply for the restoration of the missing ones, since this takes time, and then the process of obtaining the necessary services will be reduced to a minimum.

Multifunctional centers are modern institutions that are within walking distance and are a convenient way to receive various services in one place. They exist even in the smallest settlements. An increasing number of Russian citizens use them.

The process of collecting alimony payments

After a positive court decision is made to collect alimony, the plaintiff is issued a writ of execution. The writ of execution should be submitted to the Bailiff Service in person or through the portal of the State Services website. For online collection, the appropriate region and government authority is selected - the SSP Management, . Required fields:

  • Full name of the plaintiff, defendant;
  • number and date of the court order;
  • content of the requirement.

A photo or scanned copy of the writ of execution and other required documents is attached to the interactive application. A registered appeal is reviewed within 10 days. At the moment, it is possible to use the portal to go through all stages of enforcement proceedings for the collection of alimony payments.

What documents will you need to provide?

A request to register a marriage union requires a minimum package of documents. Married couples must prepare and submit the following papers to the authorized MFC inspector:

  • originals of civil passports of both partners, valid at the time of application;
  • a notarized power of attorney to perform actions on behalf of one of the future spouses (in the absence of a person);
  • a statement signed by both partners using a special template;
  • divorce certificates (if one of the partners was previously married);

How much alimony is paid?

There are three options for determining the amount of alimony obligations:

  1. A percentage of the parent's salary or other income.
  2. A fixed amount that does not depend on the income of the person from whom alimony is to be collected.
  3. A combination of these two forms, when part of the funds is interest on income, and part is a fixed fee.

Since, according to the general rules, it is the percentage collection procedure that is established, a fixed amount of alimony can be established only in cases where it is prescribed by law, namely if:

  • The income of a person who has alimony obligations is variable or unstable. This situation is possible if the parent is engaged in entrepreneurial activity by establishing the status of an individual entrepreneur, which quite often occurs in the practice of considering such cases.
  • The person on whom the obligations are assigned receives part of his income, or all of it, in kind.
  • The parent paying child support receives wages in a currency other than the Russian ruble.
  • The person from whom alimony is being collected has no income at all. In this case, establishing a fixed amount is necessary for recovery from the property of this person.
  • Collecting a percentage of alimony is impossible, or very difficult, or as a result of such a collection procedure the interests of any party to the dispute will be seriously violated. This is possible in cases of concealment of income by a person obligated to pay alimony, or if it is impossible to establish all the sources of income of this person.

To establish a fixed amount of child support, at least one of these conditions is necessary. The court may independently deviate from the general procedure for determining the amount of alimony or do so at the request of one of the parties to the conflict.

Sometimes the court may establish a mixed procedure for calculating alimony, when it is collected in two parts - interest and a fixed amount. This usually happens under the same circumstances as establishing a fixed amount of obligations in relation to the child.

At the same time, an important reason for applying such a penalty is the need to maintain the level of provision for children that was before the change in the form of their maintenance. For example, to pay for studies in a foreign country or to organize visits to certain sections or clubs, if the child had all this before the need to collect alimony arose.

The amount of monetary support, if a fixed fee is established, should provide not only the necessary needs of the child, but also maintain the provision at the level usual for him.

Moreover, it is important that such an amount is established based on the existing financial situation of the person from whom alimony is being collected.

The court should definitely establish whether the defendant, in addition to paying alimony obligations, will be able to provide himself and family members with the necessary funds. The fixed amount of funds for child support is necessarily indexed in proportion to the increase in the minimum wage.

Cases of payment changes

The court may change the amount charged in the following cases:

  • the presence of unemployed citizens supported by the defendant;
  • the person paying alimony does not work due to disability or illness;
  • the payer is a pensioner;
  • presence of other children under 18 years of age;
  • the child for whom the payments are made works or is engaged in business;
  • the child is being treated or resting in a sanatorium;
  • there is a need for special care for the one for whom the payment is made.

This is interesting! If one child is with one parent and the other is with the other, the one with the higher income pays.

How to make an appointment at the MFC

If you have an account in the ESIA system, then you can save your time by making an appointment in advance through the regional MFC website. Here's what it looks like using the Kirov region as an example.

We go to the website and immediately see a warning that the choice of appointment time is available only to registered users of the Public Services Portal with a verified account.

Go to the “Make an Appointment” tab and select the MFC that is convenient for visiting. Here it is necessary to take into account that not all centers participate in the provision of services for state registration of legal entities and. For example, the territorial department of the MFC in Kotelnich provides a limited list of services, which do not include business registration.

But in the city of Kirov, you can submit documents for registering an LLC at any of the six multifunctional centers. We select the territorial department of the MFC for the Leninsky district of Kirov and go to the registration form.

As you can see, you can sign up for this MFC on any weekday and Saturday no later than 2 p.m.

We try to select an appointment time without authorization on the Public Services Portal and receive a refusal.

We log in to the ESIA system and receive confirmation of the appointment. To activate the registration coupon, you need to enter the coupon number and PIN code into the self-service terminal a few minutes before the appointment.

If you do not have an account with the Unified Identification and Logistics Agency, you can sign up by calling the hotline of the regional MFC or on a first-come, first-served basis when visiting the center in person.

When does child support stop?

The possibility of terminating the payment of these obligations is also determined by legal norms. It is not uncommon for one of these circumstances to lead to the completion of the obligation to pay alimony:

In cases of voluntary payment of alimony:

  • The agreement regulating the issues of alimony payments has ceased to operate.
  • Circumstances indicated as stopping the payment of these alimony arose.
  • If there is a death of any party to the alimony relationship.

Provided that the funds were recovered through legal proceedings:

  • Children reaching the age of eighteen.
  • Adoption of children for whom alimony is paid (now the adoptive parent will support them). This clause does not apply when it comes to such methods of placing children as: guardianship, foster family, family-type orphanage, guardianship.
  • The minor became fully capable before reaching adulthood.
  • Subject to the death of one of the parties to the relationship.

An important point of any alimony obligations is their inseparability from the personality of the child and the person paying these sums of money, that is, it is impossible to inherit alimony or the obligation to pay it.

Circumstances that lead to termination of alimony payments

The law, of course, provides for situations where payment is terminated. Here are the circumstances leading to the end of the obligation to pay alimony:

Provided that the money was paid voluntarily:

  • The current voluntary agreement, through which all controversial issues of alimony obligations were regulated, for one reason or another ceased to be valid. The parties need some time to discuss the situation and work out the terms of a new agreement.
  • Circumstances leading to termination of payment have emerged.
  • One of the parties involved in the voluntary agreement has died and objectively can no longer be a party to the alimony relationship.

The situation when alimony was paid by court decision:

  • The children in whose favor the funds were collected have reached the age of majority (18 years).
  • The parent paid child support for the child, and he was adopted. According to the law, the responsibility for maintaining the child now passes to the adoptive parent. This provision cannot apply to other legal methods of child placement. For example, a child is taken into care, he moves to permanent residence with a foster family, becomes a resident of a family-type orphanage, or is placed under guardianship.
  • The child has not reached the age of majority, but is recognized as fully capable.
  • One of the parties to the relationship died.

Question for a lawyer

  • What documents need to be submitted to the MFC to collect alimony? MFC employees do not accept applications (claims) for the collection of alimony. The documentation is submitted directly to the judicial authority.
  • On which website can I apply for alimony? In accordance with Order of the Judicial Department at the Supreme Court of the Russian Federation dated September 11, 2017 N 168 “On approval of the Procedure for submitting documents to magistrates in electronic form, including in the form of an electronic document,” you can file a claim on the official website of the relevant magistrate court. The claim is filed in the district court on the Internet platform of the State Automated System “Justice”. You must first confirm your unified identification and authentication account or obtain an enhanced qualified electronic signature.
