All real estate transactions are a troublesome and time-consuming process with many certificates and other documents, which takes a lot of time and effort. To simplify the procedure for citizens to receive government services, including carrying out transactions with real estate, multifunctional centers have been specially created. Now each owner can privatize an apartment through the MFC, providing the authorized employee with a full package of necessary documents in accordance with the requirements of Russian legislation.
MFCs represent a connecting (intermediate) link in the chain between the consumer and state (municipal) authorities. The first multifunctional centers appeared in Russia back in 2013 with the goal of simplifying the lot of citizens and non-residents when receiving various government services. In order to receive one or another government service before the advent of the MFC, consumers had to spend a lot of time, make every effort, run around numerous authorities, collect a package of documents, which was especially difficult for people who were legally illiterate, as well as for busy people.
Today, you can receive any public service through the MFC, which is an intermediary between the applicant and the government bodies that actually provide these services. The only drawback of applying to the MFC is that you must pay for the services for privatization of living space provided by the center’s employees. But here it is everyone’s choice - someone will independently privatize the apartment, collect all the documents, go to numerous authorities, but will save money, and someone will turn to the MFC for a service, pay a symbolic amount, but will save time and effort.
The essence of the service and its results
Privatization is a procedure for transferring ownership of an apartment from public hands to private ones. The essence of the procedure is the opportunity for a citizen to become the owner of a home and begin to freely dispose of it. Only after re-registration into private hands is it possible to sell, donate, transfer by inheritance, register any people, etc. Before receiving property, a citizen has the right only to live in the apartment, but not to dispose of it.
The basis for obtaining property rights is the use of real estate under a social lease agreement. Such contracts were concluded with the population in the USSR, but are still used today to transfer housing to citizens in need of improved housing conditions.
It was originally planned that free privatization of housing would last until 2007. Subsequently, this period was repeatedly extended. In 2020, a decision was made on the indefinite right of Russians to enjoy the benefits of the procedure.
The authority responsible for the transformation of property in each subject is chosen by municipal authorities. This is a department or committee of property relations - City Housing Exchange, state property management, etc. Citizens have the right to submit documents to obtain owner status through the MFC. In Moscow, remote submission of applications is also being implemented through the municipal public services portal, but the electronic versions attached to the application must be submitted in person to the MFC on the appointed date.
Privatization through the Gosuslugi website
Using the state portal State Services, you can carry out various operations, including the privatization of an apartment. Privatization through State Services is very convenient and allows you to save a lot of time, since you don’t have to leave your home to do this. All documents can be submitted while at home. The most important thing for this is to have a computer and Internet access.
First of all, you need to register on the portal. It usually doesn't take much time. To do this, you will need your passport data and SNILS number. To perform various procedures, the account on the site must be confirmed, so passport data and SNILS will be checked.
You also need to enter your email or phone number, which will be set as your login when entering the site. You will be required to create a password.
Who can privatize an apartment?
The right to re-register state Legislators provided real estate to all Russians, but subject to a number of additional conditions.
Categories of the population that meet a number of conditions have the right to declare their desire to register ownership of an apartment:
- having Russian citizenship;
- occupying an apartment under a social tenancy agreement;
- housing is the property of municipal authorities: city, town, etc.;
- the decision to register housing rights by this person received the approval of other apartment owners and residents, including teenagers 14-18 years old;
- the citizen has not previously participated in the free privatization program.
Minors registered in the apartment are required to participate in the re-registration of rights. They can be excluded only with the permission of the guardianship authorities. Children living separately from their parents can use a privatized apartment for an unlimited time.
Adult residents can formally relinquish their ownership rights. Then they will retain the right to use the apartment and the opportunity to undergo free privatization in the future.
Garage privatization
If you need to privatize a garage, then contacting the MFC is the most correct and convenient option. There is a lot of running around with documents in this situation, and the institution has the right to make requests through official channels.
You will need to submit a minimum package of documents and write an application of a certain sample - the rest will be done by MFC employees.
It is worth noting that you will have to collect two packages of documents, one for the land, the other for the garage building.
In the first case you will need:
- passport;
- ownership of the garage;
- document on the right to use land;
- passport of the plot with cadastral number.
For your information! These documents will be submitted by MFC employees to the administration at the location of the site to consider the possibility of sale. The resolution is issued within 14 working days. After this, a purchase and sale agreement is drawn up.
In the second case:
- application for privatization - filled out at the MFC;
- passport;
- building plan and ownership;
- site plan;
- land purchase and sale agreement.
If the documents are submitted by a representative, it is necessary to issue a notarized power of attorney.
On a note! The process of privatizing a garage is complex, so you will have to wait at least six months for documents.
Step-by-step instructions for privatizing an apartment through the MFC
Step-by-step instructions for privatizing an apartment involve going through the following stages:
- You should start registering ownership of an apartment by collecting the required set of documents.
- Next, you should register at the MFC. This will allow you to avoid wasting time waiting in a live queue.
- Submit the collected documents along with the application to a conveniently located MFC. A citizen has the right to fill out an application for privatization independently or ask for help in filling out an MFC specialist. Consultations on filling out the application are free. The application in the prescribed form is signed by the privatization participants.
- Based on acceptance of the information, the center employee will issue a receipt indicating the date of provision of the public service.
- The information is verified by an authorized authority in the municipality.
- The provision of public services is completed by the issuance of a transfer agreement, on the basis of which one can assume ownership rights. It is issued personally to the applicant in paper form.
- The applicant signs the agreement on his part and submits it to the MFC for registration of ownership. Without making a mark on the property in the Unified State Register of Real Estate, the procedure will not be considered complete. The signing of the agreement takes place under the supervision of an MFC specialist. Adult residents sign the contract on their own, teenagers 14-18 years old must first obtain the support of their parents, and for children under 14 years old, parents take on the signing function. An application for registration of ownership rights is submitted along with the contract.
- Completes the registration of property rights with extracts from the Unified State Register of Real Estate. Certificates of title to an apartment are no longer issued.
After privatization of housing, not only the rights, but also the obligations to pay property tax are transferred to the new owner. The applicant may face refusal if:
- providing an incomplete set of information;
- detection of errors or inaccurate data;
- the apartment is not owned by the municipality;
- housing does not comply with legal requirements;
- the consent of the guardianship authorities to renounce the children's property rights was not obtained;
- the person has previously participated in privatization.
In the adopted resolution, municipal authorities indicate the reasons for the decision to refuse. It can be appealed in court or pre-trial.
Advantages and features of privatization in the MFC
Multifunctional centers have a significant advantage - they concentrate several services in one place. MFCs act as intermediaries between various authorities and citizens. Another plus is the ability for center employees to request various documentation, which eliminates the need to collect documents themselves. However, this service is not yet available everywhere.
Registration of privatization of an apartment through the MFC is much faster than the standard procedure in a government agency. To do this, you need to start by visiting the nearest center. Usually it is chosen according to the location of the apartment for which ownership is registered. Next, you need to submit an application for the provision of privatization services.
The specialists of the department will issue a list of necessary documents to complete the registration, and a sample power of attorney, in case the applicant is a representative of one or more owners, and they trust him to carry out the privatization.
The MFC has a fairly good support service. Those interested can contact it to obtain additional information on completing certain documents and receiving services. Employees will provide advice and explain where you can start with privatization and what features this procedure has.
Price
How much does it cost to privatize an apartment? Privatization is a free service for first-time users. But the future owner will not be able to completely avoid costs.
When registering ownership of an apartment, a state fee must be paid. For individuals, its size is set at 2000 rubles. When registering an apartment as shared ownership, the state duty is divided between the privatization participants.
When submitting an application through a representative, you must issue a notarized power of attorney. The price of notary services will be about 1800 rubles. The cost of a certificate of refusal from privatization is 1,500 rubles.
If the applicant prefers to use the services of a company to provide legal support for the procedure, then the additional costs will increase to 10 thousand rubles.
Service cost
In the MFC and on the state portal, privatization services are provided free of charge. But we must take into account that collecting a package of documents will require investing some money. They depend on prices in a certain region. You can name the approximate prices for 2020:
- Power of attorney for registration of privatization – from 500 rubles;
- Floor plan of the apartment and technical passport from the BTI - from 1,500 rubles;
- Certificate confirming non-participation in privatization – from 500 rubles;
- The state fee for drawing up a privatization agreement is 1000 rubles. (charged from each party to the contract);
- Extract from the EDGP – 200 rubles.
On average, the entire package of documents in 2020 will cost 4-5 thousand rubles.
What documents are needed?
The set of requested information is approved at the regional level. The standard set of documentation for privatization includes:
- application for public service;
- passport of the recipient of the service or other document confirming citizenship;
- birth certificate;
- passports of all registered persons in the privatized apartment over 14 years of age or those who have the right to use the housing;
- power of attorney for a representative;
- social rental agreement;
- warrant for a privatized apartment;
- an extract from the house register from July 21, 1991, or an equivalent (extract from a personal account - for Moscow);
- a document confirming the renunciation of ownership in another apartment (at the place where the applicant previously lived);
- registration certificate for the apartment and floor plan;
- consent to privatization or refusal of it on the part of all cohabiting relatives and other registered persons.
The refusal of privatization must be notarized and has a limited validity period - up to 30 calendar days. The validity of an extract from the house register also has similar monthly time limits. Most of the documents, including the warrant, are valid indefinitely.
In a number of cases, additional information is requested from the citizen: decisions of the guardianship authorities, a certificate of release, an extract from the personal file of a military contractor, etc.
The authority that is responsible for issuing the necessary data will be different. For an extract from the house register you will have to contact the management company or the HOA, for a certificate of non-use of the right to privatization - to the local government or BTI, for a floor plan - to the BTI.
If an executive order for the provision of housing (order) is lost, a copy of it must be requested from the archive. In Moscow, this document is available for order through the MFC.
When submitting an application online during a subsequent personal visit to the MFC, the citizen will have to provide:
- social rental agreement;
- a warrant or an extract from an order of the authorities;
- notarized information that was attached to the request.
General concepts
Privatization is the process of transferring state property into the ownership of individuals or legal entities on a paid or gratuitous basis.
Various objects of civil legal circulation can be classified as property.
MFC is a Russian organization that, regardless of its organizational and legal form, provides the population with state and municipal services that meet the requirements of the law.
Services can be provided electronically through a “one-stop shop”. This principle is to provide a state or municipal service after one person makes a request.
In its activities, the MFC interacts with bodies that provide state or municipal services.
Thus, MFCs perform intermediary functions between citizens and state (municipal) bodies.
Is it possible to privatize an apartment through the MFC?
In its work, the MFC is guided by the requirements of No. 210-FZ of 2010. Since 2014, the MFC has been operating under the “My Documents” brand.
The goals of creating the MFC were:
Indicators | Description |
Increased efficiency | accessibility of services provided to the population on behalf of the state |
Reducing expenses for business entities | to overcome administrative barriers |
Increasing the efficiency of executive authorities | coordination between departments |
MFC helps to privatize citizens' apartments.
An apartment is an object of real estate that meets the criteria by which real estate is classified.
The apartment belongs to the category of residential premises, therefore it must meet the requirements of Article 15, Part 2 of the Housing Code of the Russian Federation, Government Decree No. 47 of 2008, which addresses issues of suitability and unsuitability of residential premises for citizens to live in.
The apartment must be isolated and also suitable for living.
The law establishes restrictions on privatization. For example, residential premises cannot be privatized if they are recognized as unsafe and unsuitable for family living.
Citizens who are planning to privatize housing need to understand this.
What it is
Privatization is the transfer to the ownership of the population of apartments in which each person lives on the basis of social rent.
Privatization of apartments has the following characteristic features:
- Voluntariness.
- Gratuitous.
- Legality.
Privatization in the real estate market is a primary transaction. It allows the tenant(s) to become the owner of the residential premises by implementing the state program.
The state is a coherently existing mechanism consisting of authorities and management.
Each of the authorized bodies is responsible for its own area of work, which is part of the process of general social security of public life.
Rosreestr is responsible for state registration of real estate transactions, and the housing authority of the local administration in the region where the apartment is located is responsible for privatization.
How to register the privatization of an apartment through the MFC? You can submit documents for privatization and write an application at the MFC.
This organization, operating on a one-stop-shop principle, will reduce the time spent by the population on collecting, preparing, submitting documents for privatization and the process itself.
In addition, it will save a person from endless queues of people wishing to acquire property. This is an undoubted advantage of the work of the MFC. Multifunctional centers have been operating in Russia since 2013.
They provide services to the population, including the privatization of apartments. Convenience for the population lies in the fact that the necessary services are concentrated in one place.
The MFC performs intermediary functions between the state, represented by its bodies, and the population.
Privatization, which takes place through the MFC, is characterized by speed and efficiency, since employees receive the necessary papers from various government departments by sending a corresponding request.
Citizens no longer need to go to all authorities, this significantly saves their time and nerves.
As a result of privatization, the contract of the same name is registered in Rosreestr. The authority issues the citizen a certificate of ownership. This document certifies his right to living space.
From this moment on, the citizen becomes the full owner of the home. This means that he can exercise three powers, which form the basis of such a concept as “property rights” - possession, use, disposal.
In practice, this is realized by the fact that the owner of the property can sell, rent out, exchange, or donate an apartment. Nobody limits his rights.
Privatization, in addition to rights, imposes responsibilities on citizens. For example, paying property taxes to the state budget.
The basis for registering property rights is a privatization agreement - it is signed between tenants and the housing authority on whose balance sheet the apartment is located.
Who can apply
Any Russian citizen who wants to privatize housing. Where to begin? First, you need to visit the territorial division of the MFC that serves the area of residence of the person where his apartment is located.
A citizen writes an application for the provision of the relevant public service. The document can be executed by one of the residents registered in the apartment.
When submitting an application, a special document is simultaneously issued - a power of attorney, which allows employees to collect the necessary papers for privatization.
When opening an MFC, a citizen is required to provide a passport, as well as a social tenancy agreement.
Since apartments were given away by the state for social rent many years ago, many citizens do not have a warrant for residential premises. A warrant is a document on the basis of which citizens used to move into housing.
Currently, this document does not have legal force - a rental agreement is concluded instead. But the order is important from the point of view that it is often the only document confirming the tenants’ rights to the apartment.
The order cannot be restored, but documents confirming the transfer of housing can be found from the archives of the local government. A certificate of grounds for moving in is issued.
The power of attorney issued by the citizen who applies to the MFC is drawn up by a notary. It is provided at the MFC.
Deadlines
The procedure for checking documents provided by a citizen, as well as drawing up a privatization agreement, takes approximately two months.
The total time depends on the preparation time of certain documents. You should know that many of them have a limited validity period, so there is no need to delay receiving and preparing a set of documents.
What kind of housing is not allowed?
The privatization procedure is not available for some categories of real estate:
- emergency housing;
- housing in a dormitory;
- office premises (exception: housing stock of state farms and agricultural enterprises);
- apartments in closed military camps;
- specialized premises: houses for single pensioners or flexible foundations;
- real estate on the territory of production facilities and educational institutions: hospitals, kindergartens, etc.
- housing stock of social protection institutions in villages.
Apartments located in other buildings and used under a social tenancy agreement can be privatized.
To privatize a home, you are allowed to come to the MFC. The exact set of documents for completing the procedure should be clarified at the municipal level. Free privatization of housing from the municipal fund is guaranteed to Russians once in their lives.
general information
Apartment privatization is one of the services provided by the MFC.
Since January 2013, government multifunctional centers have been opening throughout the country, providing citizens with various government services .
The convenience of these centers lies in the concentration of various services in one building. The organization works as a kind of intermediary between citizens and various authorities.
One of the services provided by the MFC is the privatization of living space. The procedure carried out through this organization, as opposed to independently preparing a package of documents, is much simpler .
MFC employees receive all the necessary papers from various organizations
by submitting requests , so citizens no longer need to go through all the authorities, which significantly reduces the processing time.
Under what conditions can an apartment be privatized?
If you want to privatize an apartment, check whether your situation meets the following requirements:
- you are a citizen of the Russian Federation;
- you occupy residential premises under social rent;
- the residential premises you occupy are the property of the city of Moscow;
- you have never before used the right to participate in privatization on the territory of the Russian Federation (this rule does not apply to those who became the owner of residential premises in the process of privatization before reaching the age of majority);
- you have consent to privatize the residential premises of all adults and minors aged 14 to 18 years who have the right to privatize this residential premises.
Who has the right to privatize an apartment?
When privatizing an apartment through the MFC, first of all, it is necessary to take into account the following important point: a mandatory condition for registering residential premises as property is living in it under a social tenancy agreement. At the same time, you need to understand the legal status of the responsible tenant and other family members living in the area. They all have equal rights.
Here is a list of persons entitled to privatization:
- all apartment residents who have permanent registration;
- responsible tenant;
- children and teenagers living in the apartment, family members, regardless of their registration;
- long-term absent residents (away, on a business trip, on military service).
Note! If the tenant is absent for a long time (on a business trip, serving a sentence in a correctional facility, etc.), he must submit a written application for privatization through the MFC. Then, after returning, he will be able to exercise his right. The application has an unlimited validity period.
Many also forget one more important point: in accordance with current legislation, the right to privatization (taking ownership of a residential premises after living in it under a social tenancy agreement) can only be used once. In other words, if a person has already taken part in the program once, his right is realized. The second time, in another social rental apartment, he does not have the right to register ownership of the housing.
Registration of housing ownership
The definition of “privatization” means the process of transferring real estate from state ownership to private ownership.
The object of privatization can be:
- housing - apartments or houses;
- land plots, garden plots;
- companies.
The terminology “public service” means the provision of various services on a paid or free basis in government agencies. Based on Russian legislation, they are provided to both individuals and legal entities.
Today, all government services can be obtained through the MFC, which means a government body whose main goal is to significantly simplify the procedure for obtaining various services, including privatization.
In the privatization process, the MFC assumes the role of an intermediary between the registration authority and the applicant.
The procedure for privatization of a garden plot is determined by current legislation. How does the law on housing privatization work? See here.
Conditions of the procedure
The main condition for the privatization of housing is the absence of participation in it earlier. The rule operates on the basis of the Federal Law “On Privatization”.
However, there are some exceptions to the rules that residents should be aware of. If we are talking about minor citizens of Russia, then they can take part in privatization several times. When they reach the age of majority, on a general basis they are given the right only to participate in 1 privatization procedure - no more.
Additional conditions are considered to be the presence of all necessary documents, as well as a correctly drawn up application.
Legal regulation
When submitting the necessary documentation for the privatization of an apartment through the MFC, you must refer to several legislative acts.
In particular, Federal Law No. 210 considers:
- mechanism for contacting the MFC;
- liability of authorized persons of the MFC in case of unlawful actions;
- rules for submitting documents.
The second legislative act is considered to be Federal Law No. 1541-1, which reflects the mechanism of real estate privatization itself, and also explains the requirements for applicants and other important nuances.
