How and where to get a register of owners of apartment buildings


The law prescribes

Management organizations were obliged to maintain such a register on the basis of Federal Law No. 485-FZ of December 31, 2017. Part 3.1 appeared in Article 45 of the RF Housing Code, which contains requirements for the content of the register:

  • Last name, first name, patronymic, if the owner is an individual,
  • Legal entity – full name and state registration number;
  • Room number in the apartment building;
  • Information on the size of the owned shares in the right of common ownership of the common property of the owners of premises in the apartment building.

The register can also be ordered by phone or by mail. In 30 - 60 minutes you will be given a selection of all apartments and non-residential premises for the desired house/houses. The received document with the table will be sent by mail. You can weed out unnecessary premises and get the final price. Then a service agreement will be drawn up with you and an invoice will be issued.

Whose hands does the register fall into?

Now such a register is provided to any initiator of the general meeting of owners of apartment buildings (Part 3.1 of Article 45 of the Housing Code of the Russian Federation) within five days after submitting an application. The consent of other owners to provide a register with their personal data for the purpose of convening and organizing a general meeting is not required.

Future owners have the right to participate in general meetings of premises owners. According to Part 1.1 of Art. 44 of the Housing Code of the Russian Federation, those persons who have not yet registered their premises in Rosreestr can also take part in general meetings of owners of premises in apartment buildings and vote on the agenda of the general meeting. By virtue of the Decree of the Government of the Russian Federation dated September 13, 2018 No. 1090 “On amendments to certain acts of the Government of the Russian Federation on the management of apartment buildings,” which entered into force on September 26, 2018, maintaining a register of owners is a licensing requirement for carrying out activities related to the management of apartment buildings. Lists of owners of premises in apartment buildings must be maintained exclusively in electronic form.

What is better, ordering extracts for each apartment or one register of owners?

As mentioned above, the formation of a register of owners is possible in two ways - by independently obtaining extracts for each apartment or by turning to specialized companies for help. Let us highlight the most obvious disadvantages of the first option for register preparation:

  • the cost of obtaining an extract from the Unified State Register for each apartment will be from 200 rubles, and the cost of obtaining documents for all copyright holders will become an unbearable burden for the MKD budget;
  • obtaining separate statements for each apartment may take a long time, due to the ignorance and dishonesty of the residents;
  • if the initiative group itself decided to submit requests to the Rosreestr service, even applying through an online form will require spending a lot of time.

All these problems and difficulties can be solved by preparing a register of home owners with the help of professional specialists. In this case, there is no need to pay for each separate statement, and the cost of obtaining information for each apartment will be several times less. In addition, all received data will be compiled into a ready-made register, which can be immediately used for holding meetings of owners or other similar purposes.

Expert commentary . The advisability of independently obtaining USRN extracts directly depends on the number of apartments in the building. If there are only 5-10 residential or non-residential premises in an apartment building, it will not be difficult for even an unprepared citizen to submit a request. However, independently completing a register for a house with hundreds of premises will present obvious difficulties.

Where is the current register stored?

The register of owners is included in the documents for managing apartment buildings, which responsible persons are required to keep up to date, store, accept and transfer in the manner prescribed by law, along with other documentation regarding apartment buildings. At the same time, from January 11, 2018, the management organization is obliged not only to maintain a register of owners of premises in apartment buildings, but also to provide this register at the request of the initiator of the general meeting of owners and return it after voting.

  • Data of residential premises owners;
  • The reasons for their ownership of the apartment;
  • The number and significance of their votes at the meeting of owners, and in other situations;

The register is compiled and kept up to date by the management company or HOA, depending on the decision of the residents.

Organization of maintaining a register of apartment owners in a multi-storey building

The management organization of an apartment building (MC, HOA) must choose a document flow system that would allow at any time to restore information about the owners of residential premises and continue activities related to maintaining the register if problems arise with computers, storage media or installed software.

The need to create and maintain such a database in electronic form is to ensure the uniformity of the information entered, as well as the ability to interact with other computer systems.

In classic paper form, the register includes a ledger for the owners of apartments in a multi-storey building and registration files containing information on each owner. The management organization maintains these documents until its contract with the residents expires. The register is divided into separate years, at the beginning of each of which a new section is created on paper.

All papers are filed in the registration file as they are received, in the following situations:

  • The owner is entered into the register;
  • Any information that relates to the owner is changed;
  • The owner is excluded from the number of persons subject to registration.

The method of storing papers on the basis of which entries are made in the register is established by the owners of apartments in a multi-storey building during a general meeting. From the moment the contract expires, the fate of the documents is regulated by Art. 162 Residential Complex of Russia. The same thing awaits them as technical papers for a multi-story building.

Having accepted the documents, the management company or homeowners association provides the owner with written confirmation of this fact. In it, an authorized employee of the management organization indicates his full name, puts a date and signature, and then certifies all this with a seal.

The register is maintained by a person appointed by the chairman of the HOA or the director of the management company. The documents contain information about the owners of apartments in a multi-story building and certificates that provide grounds for entering data. Each owner has a certain share in the common property, which is recorded in the register. It is also expressed in the number of votes at a meeting of residents.

You can calculate what share the apartment owner has in the common property using the formula: D = (SK / SH) × DK × 100, where

D – the share that the owner has in the common property.

SK – total area of ​​the apartment.

SH is the total area of ​​a multi-storey building.

DK – share in an apartment or non-residential premises owned by the owner.

The entry or exclusion of the owner of an apartment from the register occurs by making an appropriate entry in the accounting book and registration file. Changing existing information occurs in a similar way.

How and where is documentation compiled?

You can obtain the register of owners in two ways:

  • with the help of Rosreestr;
  • by filling out the form/form yourself.

The first method will require money. After filling out the application form, you must wait 5 calendar days and then receive it. The service is not free, on the contrary, it is quite expensive. The cost of creating a database is calculated as follows: take 200 rubles, multiply by the number of apartments, and get the full cost (for individuals). It should be noted that the tariff for legal entities is higher - 600 rubles per premises.

To obtain the register, you must go to the Rosreestr website. To do this you need to go through a simple registration procedure. You can obtain information for this simple procedure by contacting the Unified State Register, in person, or using the Internet, which will significantly save time.

Leave a request on the website to obtain a certified extract of ownership of the living space. Issued upon availability of an application for receipt, a passport, and necessarily a receipt for paid state duty (in the amount of 100 rubles up to 3 thousand). The package of documents is transferred to a branch of Rosreestr or MFC. An employee of the organization is obliged to indicate the time frame for receiving the extract.
